HomeMy WebLinkAbout15942 ORD - 12/17/1980vp:12/16/80:1st AN ORDINANCE CLOSING AND ABANDONING A 10 -FOOT WIDE UTILITY EASEMENT OUT OF LOTS 5 AND 6, BLOCK 4, INTERSTATE INDUSTRIAL COMPLEX, AS SHOWN BY MAP WHICH IS RECORDED IN VOLUME 44, PAGES 124 AND 125, MAP RECORDS OF NUECES COUNTY, TEXAS, SUBJECT TO REPLATTING BY THE PROPERTY OWNERS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot wide utility easement out of Lots 5 and 6, Block 4, Interstate Industrial Complex, as shown by map which is recorded in Volume 44; pages 124 and 125, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement subject to replatting by the property owners; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described 10 -foot wide utility easement out of Lots 5 and 6, Block 4, Interstate Industrial Complex, as shown by map which is recorded in Volume 44, Pages 124 and 125, Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, said easement being described as follows: FIELDNOTES for the abandonment of a 10.00 foot wide utility easement out of Lots 5 and 6, Block 4, Interstate Industrial Complex, a map of which is recorded in Volume 44, Pages 124 and 125, Map Records of Nueces County, Texas: BEGINNING at a point on the South right-of-way line of a railroad right-of- way South 67°24'14" East 5.0 feet from the Northwest corner of said Lot 6 and Northwest corner of this easement; THENCE South 67°24'14" East, along said South right-of-way line, 280.00 feet to a point on the West lot line of said Lot 5 for the Northeast corner of Lot 6 and an inside corner of this easement; THENCE North 23°57'43" East, along the West lot line of said Lot 5, 20.01 feet to a point on the South right-of-way line of said railroad right-of-way for the Northwest corner of said Lot 5 and a corner of this easement; THENCE South 67°24'14" East along said right-of-way line, 5.00 feet to a point for the Northeast corner of this easement; THENCE South 23°57'43" West, leaving said right-of-way line, 70.13 feet to a point for Southeast corner of this easement; THENCE North 66°02'17" West at 5.0 feet pass the common lot line' of said Lots 5, 6, in all a distance of 10.00 feet to a point for a corner of this easement; THENCE North 23°57'43" East 39.88 feet to a point for an inside corner of this easement; MiCROBNED 15942 SSP 271984 THENCE North 67°24'14" West, 275.00 feet to a point Southwest corner of this easement; THENCE North 23°57'43" East, a distance of 10.00 feet to the POINT OF BEGINNING. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /7 day of December, 1980.
