HomeMy WebLinkAbout15944 ORD - 12/17/19801p:12/16/Q0;1st 0 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE INTERGOVERNMENTAL COOPERATION AGREEMENT WITH THE NUECES COUNTY ATTORNEY'S OFFICE FOR CONTINUATION OF THE WITNESS COORDINATOR PROGRAM, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute Inter- governmental Cooperation Agreement with the Nueces County Attorney's office for continuation of the Witness Coordinator Program, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to execute the aforesaid agreement at the earliest practicable date in order that the Witness Coordinator Program continue without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the . City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /7 day of December, 1980. BRUCE AYCOCK, CITY ATTORNEY MAYORpcm1T€m THE CITY /OF CORPUS CHRISTI, TEXAS M GRQEILMED 15944 BSEP 271984 STATE OF TEXAS COUNTY OF NUECES INTERGOVERNMENTAL COOPERATION AGREEMENT This agreement entered into by and between Nueces County Attorney's Office and the City of Corpus Christi, Texas, with the approval of their respective governing bodies. WHEREAS, the position of Witness Coordinator in service at the Nueces County Courthouse has been mutually beneficial to both City and County Law Enforcement Agencies; and WHEREAS, services rendered by the Witness Coordinator Program have been directly beneficial to the County Attorney's Office and its efforts to prosecute serious misdemeanor offenses; and WHEREAS, economic realities are such that the salary of the position of Witness Coordinator prior to this agreement was not sufficiently competitive to allow for the hiring and retention of persons capable of fully rendering the service of a Witness Coordinator; and WHEREAS, in recognition of the fact that many services rendered by the Witness Coordinator though of benefit to City Law Enforcement efforts are also directly beneficial to County Law Enforcement and, in particular, the prosecution efforts of the Nueces County Attorney's Office: NOW THEREFORE, be it agreed by and between the Police Department of the City of Corpus Christi and the Nueces County Attorney's Office that in consideration of the continuation of the program at a higher level of pay than was originally budgeted, the Nueces County Attorney's Office agrees to provide up to the sum of Two Hundred Dollars ($200.00) per month or Six hundred Dollars ($600.00) per quarter payable in advance to reim- burse the City of Corpus Christi for additional expenses directly related to the services of the Witness Coordinator as they are rendered to the Nueces County Attorney's Office. It is understood that the funds so provided are out of the discretionary fund provided by Article 53.08 of the Code of Criminal Procedure and do constitute an expense of the office of County Attorney. It is further understood that this agreement in no O way binds the County of Nueces but constitutes an encumbrance soley upon the funds provided by Article 53.08, C.C.P. It is further understood that this agreement is cancellable on notice in writing of either party with sixty (60) days notice, or upon the death, resignation, or other termination of the person holding the position of Witness Coordinator at the time of this agreement. It is further understood that the position of fitness Coordinator shall remain under the sole supervision and control of the City, and be subject exclusively to the City's personnel policies.
