AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, AP-
PEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF
THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM
TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE
NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH,
1961, AS AMENDED, BY AMENDING ARTICLE III. PERMITS, PLATS
AND FILING FEES, SUBSECTIONS 33-3.01, 33-3.02 AND 33-3.03
SO AS TO PROVIDE FOR PAYMENT IN ADVANCE OF $150 FOR
APPEALS TO THE BOARD OF ADJUSTMENT; FOR CHANGE OF ZONING
DISTRICT,PAYMENT OF $200 FOR LESS THAN 10 ACRES, $300 FOR
10 TO 20 ACRES AND $550 FOR MORE THAN 20 ACRES; AND PAY-
MENT OF $200 FOR FENCE EXCEPTIONS; PROVIDING FOR REFUND
OF 35% OF THE APPLICATION FEE IF THE APPLICANT WITHDRAWS
HIS REQUEST BEFORE IT IS FORWARDED TO THE CITY COUNCIL;
DELETING SUBSECTION 33-3.04 IN ITS ENTIRETY; KEEPING IN
EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS
AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning amendment to the zoning map of
the City of,Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and •be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, December 17,
1980, at Regular Council Meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9,
pages 565, et seq, of the Ordinance and Resolution Records, as amended from
time to time, and in particular as amended by Ordinance No. 6106, as amended,
be and the same is hereby amended by making the change hereinafter set out.

SECTION 2. That Article III. PERMITS, PLATS AND FILING FEES,
of the Zoning Ordinance be amended by deleting Subsection 33-3.01 in its
entirety and in lieu thereof substituting the following:
"33-3.01 Any person, firm, or corporation appealing to the
Board of Adjustment, necessitating the sending of
notices and publications of notices to the newspaper
shall be required to pay in advance One Hundred Fifty
($150) Dollars for expenses relative thereto."
SECTION 3. That Subsection 33-3.02 be deleted in its entirety and
in lieu thereof substituting the following:
"33-3.02 Any person, firm, or corporation upon filing with the
Department of Planning and Urban Development of any
application for a zoning district classification change,
necessitating the sending of notices and publication of
notices in the newspaper shall be required to pay in.
advance the following applicable sum:
For requests for classification change of
Less than -10 acres $200
10 acres or more, but
less than 20 acres . . 300
20 acres or more 550
In the event the Planning Commission does not favorably
recommend the zoning district change and the applicant
withdraws his application before it is forwarded to the
City Council for public hearing and determination as
provided in Article 30 of this ordinance, then 35% of
the application fee shall be refunded upon written
request by the applicant.
An application for a zoning district classification
change initiated by the City Council, the Planning
Commission, any City staff member (acting in his
capacity.as City.staff member) or any other Board
or Agency of the City of Corpus Christi shall be
without fee." -

SECTION 4. That Subsection 33-3.03 be deleted in its entirety and
in lieu thereof substituting the following:
"33-3.03 Fence Exceptions. Any person, firm or corporation,
upon filing a request with the Department of Planning
and Urban Development for an exception to the require-
ment of Subsection 27-3.01.06 of this ordinance,
necessitating the sending of notices and publication
of notices in the newspaper, shall be required to pay
in advance Two Hundred ($200) Dollars. In the event
the Planning Commission does not favorably recommend
the fence exception and the applicant withdraws his
request before it is forwarded to the City Council
for public hearing and determination as provided in
Article 30 of this ordinance, then 35% of the applica-
tion fee shall be refunded upon written request by
the applicant."
SECTION 5. That Subsection-33-3.04 be and the same is hereby
deleted in its entirety.
SECTION 6. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed to the extent of such conflict.
