AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH THE STATE DEPARTMENT OP HIGHWAYS & PUBLIC TRANS-
PORTATION IN WHICH THE CITY OF CORPUS CHRISTI AGREES
TO ERECTION OF RAILROAD CROSSING WARNING SIGNALS AT
THE INTERSECTION OF DRISCOLL STREET AND THE TEX-MEX
RAILROAD (NEAR AGNES STREET) TO BE PERFORMED BY THE
STATE DEPARTMENT OP HIGHWAYS & PUBLIC TRANSPORTATION,
A SUBSTANTIAL COPY OF WHICH AGREEMENT IS ATTACHED
HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A";
APPROPRIATING $2,750 OUT OF THE NO. 220 STREET BOND
FUND APPLICABLE TO PROJECT NO. 220-77-45, DRISCOLL
STREET AND TEX-MEX RAILROAD CROSSING SIGNALIZATION;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be,authorized to execute an
agreement with the State Department of Highways & Public Transportation
in which the City of Corpus Christi agrees to erection of railroad crossing
warning signals at the intersection of Driscoll Street and the Tex-Mex
Railroad (near Agnes Street) to be performed by the State Department of
Highways & Public Transportation, a substantial copy of which agreement is
attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That there is hereby appropriated the sum of $2,750
out of the No. 220 Street Bond Fund applicable to Project No. 220-77-45,
Driscoll Street and Tex-Mex Railroad Crossing Signalization.
SECTION 3. The necessity to authorize execution of the aforesaid
agreement and to appropriate the sums necessary to provide for erection of
railroad crossing warning signals as hereinabove more fully described
creates a public emergency and animperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be passed
finally on the date of its introduction but that such ordinance or resolution
shall be read at three, several meetings of the City Council, and the Mayor
having declared that such emergency and necessity exist, having requested
the suspension of the Charter rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and

effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the

and accepts the project for the protection of the described
grade crossing and agrees to forward its remittance to the
Department in the approximate amount of $
upon request. The exact amount is to be determined at the
time of project approval. The undersigned also agrees that
advance warning signs and pavement markings will be in
accordance with State and Federal standards at the time of
project completion.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
