HomeMy WebLinkAbout15977 RES - 01/14/1981A RESOLUTION ENDORSING PASSAGE BY THE TEXAS STATE LEGISLATURE OF LEGISLATION PROHIBITING THE SELLING, POSSESSION, OR DISCHARGING OF FIREWORKS IN THE STATE OF TEXAS, NUECES COUNTY, OR CITY'S 5 -MILE EXTRATERRITORIAL JURISDICTION; AND DECLARING AN EMERGENCY. WHEREAS, the cost to taxpayers for fire suppression and fire prevention resulting from the selling, possession, and discharging of fireworks within the State of Texas continues to increase annually; and WHEREAS, the City Council, recognizing the need to prohibit the selling, possession, or discharging of fireworks within the City's limits,has previously passed ordinances making such activities illegal within the City and within 5,000 feet of the City's limits, and WHEREAS, the availability of fireworks beyond the 5,000 feet limit from the City and the selling of such fireworks in areas not regulated by the City has resulted in continued and substantial personal property losses and injuries; and WHEREAS, the estimated personal property losses within Corpus Christi amounted to over a total of $385,000 in 1979 and 1980 as a result of roof and grass fires attributed to the discharging of fireworks; and WHEREAS, the City has long recognized the need to seek additional remedies other than to just ban fireworks from within the City's limits: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Council of the City of Corpus Christi endorses the passage of legislation amending Article 9205 of the Revised Civil Statutes of Texas to prohibit the selling, possession, or discharging of fireworks within the State. SECTION 2. If such a prohibition is unobtainable, the City Council endorses the passage of legislation to prohibit the selling, possession, or dis- charging of fireworks within Nueces County or within the City's 5 -mile extra- territorial jurisdiction. Such a prohibition should not seek to ban supervised displays of fireworks by municipalities, fair associations, amusement parks, or other organizations or groups of individuals complying with prescribed legal and safety requirements. SECTION 4. The necessity of taking a position on the prohibition of the selling, possession, or discharging of fireworks in the State, Nueces County, or the City's 5 mile extraterritorial jurisdiction, as hereinabove set forth, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this resolution be passed finally on the date of its introduction and take effect and be in full force_and of ct from and after its passage, IT IS ACCORDINGLY SO RESOLVED,; this the day of January, 1981.
