HomeMy WebLinkAbout15987 ORD - 01/21/1981jkh:1-21-81;lst AN ORDINANCE CLOSING AND ABANDONING THE 10 -FOOT WIDE UTILITY EASE- MENT LOCATED BETWEEN LOT 1-R AND LOTS 2, 3, 4 AND 5, CORMAR INDUSTRIAL TRACTS, AS SHOWN BY PLAT RECORDED IN VOLUME 44, PAGE '35, AND BY PLAT RECORDED IN VOL. 25, PAGE 65, MAP RECORDS, NUECES COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot wide utility easement between Lot 1-R and Lots 2, 3, 4 and 5, Cormar Industrial Tracts, as shown by plat recorded in Volume 44, page 35, Map Records of Nueces County, Texas, and by plat recorded in Volume 25, page 65, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described 10 -foot utility easement located between Lot 1-R and Lots 2, 3, 4, and 5, Cormar Industrial Tracts, as shown by plat recorded in Volume 44, page 35, qnd by plat recorded in Volume 25, page 65, both in the Map Records of Nueces County, Texas, said easement being described as follows: Being a 0.076 acre, more or less, tract of land out of Lot 1-R, Cormar Industrial Tracts, as shown by plat recorded in Volume 44, page 35, and out of Lots 2, 3, and 4, Cormar Industrial Tracts, as shown by plat recorded in Volume 25, page 65, both in the Map Records, Nueces County, Texas, said tract being more particularly described as follows: Beginning at the southeast corner of said Lot 2, said point being an interior corner of said Lot 1-R for an exterior corner and POINT OF BEGINNPPPG of this tract; THENCE, S 30° 01' 20" W, 5.00 feet to a point for the southeast corner of this' tract; THENCE, N 59° 58' 40" W, 327.92 feet to a point for the southwest corner of this tract; THENCE, N 00 03' 40" E, 11.54 feet to a point for the northwest corner of this tract; THENCE, S 59° 58' 40" E, 333.59 feet to a point on the east boundary line of said lot 2 for the northeast corner of this tract; THENCE, S.29° 00' 00" W along said east boundary line, 5.00 feet to the POINT OF BEGINNING. If for any reason any section, paragraph, subdivison, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause „phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution sha11 be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ,/ay of January, 1981. • ATTEST: City Secretary APPROVED: 2-4 DAY OF JANUARY, 1981: J. For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally,on the date it is introduced, or at the present meeting of the City Council.
