Home My WebLink About15998 ORD - 01/28/1981jkh:1-28-81;lst AN ORDINANCE CLOSING A SMALL STUB STREET IN CASTLE PARK, UNIT 1, AT THE INTERSECTION OF LOMBARDY DRIVE AND CASTLE PARK DRIVE, AND ABANDONING A 10 -FOOT UTILITY EASEMENT IN THE SAID SUBDIVISION; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of a small stub street in Castle Park, Unit 1, more fully described hereinafter, at the intersection of Lombardy Drive and Castle Park Drive, as shown by map or plat recorded in Volume 43, pages 158 and 159, Map Records of Nueces County, Texas, situated in the City of Corpus Christi, and the abandonment of the hereinafter more fully described 10 -foot utility easement in the subdivision, was given by publication and mail to the last known address of the owners of property abutting said areas and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing wa-s held at Regular Council Meeting of the City Council of the City of Corpus Christi on Wednesday, January 21, 1981, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the portion of said street and the hereinafter more fully described easement, and that the same revert to the abutting property owners: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described small stub street in Castle Park, Unit 1, at the intersection of Lombardy Drive and Castle Park Drive, be and the same is hereby closed for public use and abandoned to the abutting property owners: Being a street right-of-way stub -out at the intersec- tion of Lombardy Drive and Castle Park Drive, Castle Park, Unit 1, a map of which is recorded in Volume 43, pages 158 and 159, Map Records of Nueces County, Texas: 15998 •SSP z! 1984 BEGINNING at a point on the intersection of the North right-of-way line of Castle Park Drive and the West right-of-way line of Lombardy Drive for the Northeast corner of Lot 34, Block 2 of said Castle Park -Unit 1 and the Southwest corner of this tract from which corner the common rear corner of Lots 18, 19 and 34, Block 2 of said Castle Park -Unit 1 bears North 61°04'00" West 105.00 feet; THENCE North 28°56'00" East 9.32 feet for the Northwest corner of this . tract; THENCE South 61°04'00" East 60.00 feet for the Northeast corner of this . tract and point of curvature of a circular curve to the right whose radius .point bears South 61°04'00" -East and has a central angle of 90°00'00", a radius of 10.00 feet, a tangent of 10.00 feet and an arc length of'15.71 feet; THENCE with said circular curve 15.71 feet to a point on the North right- of-way line of Castle Park Drive for the point of tangency and the Southeast corner of this tract; THENCE North 60°30'35" West, 70.00 feet to the POINT OF BEGINNING. and that the hereinafter more fully described 10 -foot wide utility easement in the aforesaid subdivision be and the same is closed and abandoned to the abutting property owners: Being a 10.00 foot wide utility easement, comprised of a 5.00 foot wide utility easement out of Lots 1 through 6, Block 3, Stoddard Smith Subdi-- vision Unit One, a map of which is recorded in Volume 23, page 9, Map Records of Nueces County, Texas and a 5.00 foot wide utility easement out of Lot 9, Section 49, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, pages 41, 42, and 43, Map Records of Nueces County, Texas; BEGINNING at a point on the South right-of-way line of Division Road for .the South corner of this easement from which corner the common corner of said Lot 9 and said Lot 1, Block 3, bears North 61°04'00" West 5.00 feet; THENCE South 28'56'10" 'West, parallel to the common boundary Sine of said Lots 1 thru 6 and said Lot 9, Section 49 thereof and 5.00 feet distant therefrom, measured at right angles thereto, 460.68 feet to a point on the North right-of- way line of Castle Park Drive for the Southwest corner of this easement; THENCE North 61°04'50" West, with said North right-of-way line, 10.00 feet. to a point for the Northwest corner of this easement; THENCE North 28°56'20" East, parallel to said common boundary line thereof and 5.00 feet distant therefrom, measured at right angles thereto, 460.68 feet to a point on the South right-of-way line of Division Road for the Northeast corner of this easement; THENCE South 61°04'00" East, with said South right-of-way line, 10.00 feet to the POINT OF BEGINNING. ' -2- SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid stub -out street and utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the d2X day of 1981.
