AUTHORIZING THE CITY MANAGER TO EXECUTEAN AGREEMENT WITH
THE STATE OF TEXAS, THROUGH THE STATE DEPARTMENT OF HIGHWAYS
AND PUBLIC TRANSPORTATION, PROVIDING FOR THE STATE TO REIMBURSE
THE CITY WITH FEDERAL EMERGENCY RELIEF FUNDS FOR REPAIR WORK
RELATED TO HURRICANE ALLEN DAMAGE ON OCEAN DRIVE FROM THE
ALAMEDA JUNCTION TO THE NAVAL AIR STATION, TO THE ENNIS JOSLIN
ROAD BRIDGE AND TO TRAFFIC SIGNALS, SIGNS AND MARKINGS; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with the State of Texas, through the State Depart-
ment of Highways and Public Transportation, providing for the State to
reimburse the City with Federal Emergency Relief Funds for repair work
related to Hurricane Allen damage on Ocean Drive from the Alameda Junction
to the Naval Air Station, to the Ennis Joslin Road bridge, and to traffic
signals, signs and markings, all as more fully set forth in the agreement,
a substantial copy of which is attached hereto and made a part hereof, marked
Exhibit "A".
SECTION 2. The necessity to authorize execution of the aforesaid
agreement at the earliest practicable date in order that the City may be
reimbursed for repair work occasioned by Hurricane Allen creates a public
emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally on
tfie date of its introduction but such ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor having declared
such emergency and necessity to exist, having requested the suspension of
said Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of February,
1981.

This AGREEMENT, made this day of
19 , between the State of Texas, acting through the State
Department of Highways and Public Transportation, hereinafter
called the "State", Party of the First Part, and the City of
Corpus Christi, acting by and through its duly authorized
officers, hereinafter called the "City", Party of. the Second
Part;

WHEREAS, the City has requested assistance in repairing
damages to Metropolitan Highways within the City resulting from
Hurricane Allen; and
WHEREAS, Nueces County has been declared a disaster area
by the Governor; and
WHEREAS, it has been determined that the cost of such
repair of damages are eligible for Federal Emergency Relief
Funds since these Metropolitan Highways are on the Federal -Aid
Highway System.
AGREEMENT
NOW TIHEREFORE, in consideration of the premises and of the
mutual covenants and agreements of the parties hereto to be by
them respectively kept anJ perfoimt•d as hereinafter set forth,
it is agreed as follows:
1. The "State" agrees to apply for Federal Emergency Relief
Funds for repairing damages to Metropolitan highways within
the City as indicated in Exhibit "A" attached hereto resulting
from Hurricane Allen.
2. The "State" agrees that the "City" may perform the repairs
with City forces at locations indicated in Exhibit "A" on a
"Force Account" basis.
3. The "State" agrees to reimburse the "City" tjie cost of the
repairs under a "Force Account" basis not exceed an amount
equal to the Federal Emergency Relief Funds received for said
repairs.
a. Upon completion of the repairs anJ final acceptance by
the State, and FHWA, the State will make one payment when
the City has submitted a final and complete billing of all
costs. This billing must include properly prepared and
executed Form 132 and a final bill summarized by each
classification of costs showing description, quantity, unit
price and extensions and total. Labor additives or burden
and material handling rates must be shown as a percentage
factor and applied to the total cost of labor or materials
as applicable.

b. Unsupported charges or charges after final acceptance by
the State will not be considered eligible for reimburse -
met. Prior to final payment an audit of the records
supporting the costs claimed will be made. These records
must he made available to authorized representatives of
the State and other agencies involved in the funding of
this Project during the normal workday. Ai] records
relating to this project must be maintained by the City
for 3 years after receipt of final payment from the State.
If the State is not reimbursed in its entirety by PHWA,
the City will make compensation to the State for any
difference.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
