AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT
TO THE CONTRACT BETWEEN THE CITY AND NUECES COUNTY
FOR SPONSORSHIP OF THE NUECES COUNTY MENTAL HEALTH -
MENTAL RETARDATION COMMUNITY CENTER TO PROVIDE
COUNTY SUPERVISION OF THE CENTER, ALL AS MORE FULLY
SET FORTH IN THE AMENDED CONTRACT, A SUBSTANTIAL
COPY OF WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMER-
GENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute an
amendment to the contract between the City and Nueces County for sponsorship
of the Nueces County Mental Health -Mental Retardation Community Center to
provide County supervision of the Center, all as more fully set forth in
the amended contract, a substantial copy of which is attached hereto and
made a part hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize execution of the aforesaid
amended contract at the earliest practicable date in order that the terms
and understanding between the parties may be reduced to writing creates a
public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction and take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the
day of February, 1981.

AMENDED CONTRACT
THE STATE OF TEXAS $
COUNTY OF NUECES
WHEREAS, on March 5, 1975 the County of Nueces and the City of
Corpus Christi entered into a joint contract for the purpose of establishing
and operating the Nueces County Mental Health -Mental Retardation Community
Center for mental health and mental retardation services under the law of
the State of Texas; and
WHEREAS, on August 17, 1979 said contract was amended to provide
that the County would assume all joint responsibilities through July 31, 1980
and the City would provide a payment of $45,000 during 1979-80; and
WHEREAS, it has been determined by the parties to the aforesaid
contract that it would be advantageous to continue the understandings set
forth in the August 17, 1979 agreement:
NOW, THEREFORE, BE IT AGREED by the sponsoring agencies, County of
Nueces and City of Corpus Christi, that the contract heretofore entered into
between the parties, as amended on March 5, 1975, be and the same is hereby
further amended by amending Section "F" to read as follows: -
"F. ASSUMPTION OF DUTIES.
1. During the period ending July 31, 1981, the County will assume
all duties previously performed jointly by said County and City as set out
in Sections A, B, C and E of the joint contract, including the appointment
of all board members to the Community Center which shall become vacant during
the period ending July 31, 1981. In addition, the County will appoint the
Public Responsibility Committee mandated by the MR Persons Act of 1977.
2. It is specifically understood by the parties through this agree-
ment that the County will not provide all local government funding. For the
current fiscal year 1980-1981 the City of Corpus Christi agrees to provide
the MH -MR Community Center $45,000 and the County of Nueces agrees to provide
at least $80,000.00. The County and City agree to conduct a joint meeting
on or before July 31, 1981 and prior to the adoption of the City budget, to
discuss continuation of this agreement, including a determination of the amount
the City and the County will consider contributing to the MH -MR Community
Center in fiscal year 1982.
Except as herein and hereby amended, the terms and conditions of the
contract heretofore entered into by the parties shall be and remain in full
force and effect including amendment of amendment of April 22, 1975.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
