AN ORDINANCE
AMENDING ORDINANCE NO. 8127, AS AMENDED, BY AMENDING
SECTION 800 OVERTIME COMPENSATION, SUBSECTION 802
OVERTIME COMPENSATION, SO AS TO PROVIDE FOR OVERTIME
ALLOWANCE FOR ADDITIONAL CLASSES OF EMPLOYEES UNDER
THE CITY'S COMPENSATION PLAN, AS MORE FULLY SET FORTH
HEREINAFTER• AMENDING ORDINANCE NO. 3658, SECTION 250
AND ORDINANCE NO. 8127, SECTION 510, BY CHANGING CERTAIN
TITLES AND SERIES, MORE FULLY OUTLINED HEREINAFTER;
PROVIDING A SEVERANCE CLAUSE; PROVIDING AN EFFECTIVE DATE;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Ordinance No. 8127, as amended, the City of Corpus
Christi Compensation Plan, be amended by amending Section 800 OVERTIME COMPEN-
SATION, Subsection 802. Overtime Compensation, to hereafter read as follows:
"802 Overtime Compensation
All full-time employees in positions of Grade 22 and below, all
positions in the Labor and Trades series, Engineering Design personnel, and
all positions in the Police and Fire Series except Police and Fire Chiefs,
Assistant Police Chiefs, and Police Commanders when assigned duties normally
attendant to their management responsibility, shall be paid for authorized
overtime work at the rate of one and one-half times the regular rate, pro-
vided that such rate for positions in the Fire Series with scheduled work
needs other than 40 hours shall be computed on the basis of 173.33 hours
per month. Compensatory time off equal to the actual hours of overtime may
be granted and scheduled at the discretion of the department head concerned.
Employees within the Police Series may elect, with the concurrence of the
department head, to be granted compensatory time off at the rate of one and
one-half times the actual hours of overtime worked in lieu of overtime cash
payment. Other salaried officers and employees in positions of Grade 23 or
above, excluding positions in the Labor and Trades Series, and Engineering
Design personnel, shall not be eligible for regular overtime compensation as
provided above, but may be granted compensatory time off in unusual cases
when authorized by the City Manager; except upon authorization of the City
Manager, overtime work may be paid on a straight time basis or at the rate
of one and one-half times the regular rate for work performed under contracts
or agreements with other governmental jurisdictions or agencies or without
contracts in the event of emergency." NCKEILMED

SECTION 2. That Ordinance No. 3658, Section 250, and Ordinance
No. 8127, Section 510, be amended so as to change the following Class Titles
from Labor and Trades to Administrative, Executive, Professional and Laborers Series:

SECTION 3. The effective date of the above change shall be from
and after the passage of this ordinance.
SECTION 4. If any section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance shall be held invalid or unconstitutional
by final judgment of a court of competent jurisdiction, it shall not affect
any other section, paragraph, subdivision, clause, phrase, word or provision
of this ordinance, for it is the definite intent of this City Council that
every section, paragraph, subdivision, clause, word, phrase or provision
hereof be given full force and effect for its purpose.
SECTION 5. The necessity to maintain at all times an efficient
administration of City affairs creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordi-
nance or resolution shall be passed finally on the date of its introduction

but that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared that such emergency and
necessity exist, having requested the suspension of the Charter rule and
that this ordinance be passed finally' on the date of its introduction and
take effect and be in full force and eff ct from and after its passage, IT
IS ACCORDINGLY SO ORDAINED this the day of February, 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
