AN ORDINANCE
CLOSING AND ABANDONING THE 10 -FOOT AND 20 -FOOT WIDE ALLEYS
IN BLOCKS 9, 10, 11 AND 12, LA PASCUA NO. 2, AS RECORDED IN
VOLUME 13, PAGE 50, MAP RECORDS OF NUECES COUNTY, TEXAS;
RETAINING ALL OF SAID ALLEYS AS UTILITY EASEMENTS EXCEPT THE
100 -FOOT LONG BY 20 -FOOT WIDE PORTIONS, MEASURED FROM YOLANDA
DRIVE, BETWEEN LOTS 36 AND 37, BLOCK 10, AND BETWEEN LOTS 41
AND 42, BLOCK 9, THE 104 -FOOT LONG BY 20 -FOOT WIDE PORTIONS,
MEASURED FROM YOLANDA DRIVE, BETWEEN LOTS 10 AND 11, BLOCK 11,
AND BETWEEN LOTS 15 AND 16, BLOCK 12; PROVIDING FOR REVERTING
TO THE ABUTTING PROPERTY OWNERS OF 10 FEET, OR ONE-HALF OF ALL
20 -FOOT WIDE ALLEYS, AND FOR ALL OF THE 10 -FOOT WIDE ALLEY IN
BLOCKS 11 AND 12, LA PASCUA NO. 2, TO REVERT TO ABUTTING
PROPERTY OWNERS TO THE WEST IN THE SAID LA PASCUA NO. 2 SUB-
DIVISION, ALL AS MORE FULLY DESCRIBED ON THE MAPS OR PLATS
ATTACHED HERETO AS EXHIBITS "A" AND "B"; PROVIDING FOR SEVER-
ABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing con-
cerning the closing of 10 -foot and 20 -foot wide alleys in Blocks 9, 10, 11
and 12, La Pascua No. 2, as recorded in Volume 13, page 50, Map Records of
Nueces County, Texas, in the City of Corpus Christi, Texas, was given by
publication and mail to the last known addresses of the property abutting
the alleys proposed to be closed and within 450 feet of the area to be closed,
and thereafter, pursuant to said notice, public hearing was held at Regular
Council Meeting by the City Council of the City of Corpus Christi on
January 28, 1981, in accordance with the provisions of the City Charter;
and
WHEREAS, it has been determined by the City Council after such
hearing that it would best serve the public convenience and necessity to close
the easements within the limits hereinafter set forth for use as a public
alley, subject to retention of the alleys as utility easements except for the
portions described hereafter:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the 10 -foot and 20 -foot wide alleys in Blocks 9,
10, 11 and 12, La Pascua No. 2, as recorded in Volume 13, page 50, Map Records
of Nueces County, Texas, situated in the City of Corpus Christi, Nueces County,
Texas, be and the same are hereby closed for public use and abandoned to the
abutting property owners, save and except that the said alleys shall be
retained as utility easements except the 100 foot long by 20 -foot wide portions,

measured from Yolanda Drive, between Lots 36 and 37, Block 10, and between
Lots 41 and 42, Block 9, the 104 -foot long by 20 -foot wide portions, measured
from Yolanda Drive, between Lots 10 and 11, Block 11, and between Lots 15 and
16, Block 12; and providing that 10 feet, or one-half of all 20 -foot wide
alleys revert to abutting property owners, and that all of the 10 -foot wide
alley in Blocks 11 and 12, La Pascua No. 2 revert to abutting property owners
to the west in the La Pascua No. 2 Subdivision, as more fully described on
the map or plat attached hereto and made a part hereof, marked Exhibit A.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction,
it shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
or provision hereof be given full force and effect for its purpose.
SECTION 3. The fact that the public convenience and necessity would
be better served by the closing of the hereinabove described alleys creates
a public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor, having
declared that such emergency and necessity exist, having requested the suspen-
sion of the Charter rule and that this ordinance be passed finally on the
date of its introduction and take effect and be in full force and effect from
and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the T day
of February, 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
