CLOSING AND ABANDONING A PORTION OF EASEMENT GRANTED TO
HUMBLE PIPE LINE COMPANY AS RECORDED IN VOLUME 227, PAGES
346 AND 347, DEED RECORDS OF NUECES COUNTY, TEXAS, SAID
EASEMENT PREVIOUSLY ASSIGNED TO THE CITY OF CORPUS CHRISTI
AS RECORDED IN VOLUME 1319, PAGE 249, DEED RECORDS OF
NUECES COUNTY, TEXAS, SAID PORTION OF PIPELINE EASEMENT TO
BE CLOSED BEING LOCATED ACROSS THE NORTH ONE-HALF OF LOT 25,
SECTION 18, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS,
PROVIDED THE OWNER FURNISHES AN ALTERNATE EASEMENT FOR THE
FOUR -INCH GAS PIPELINE; AND DECLARING AN EMERGENCY.
WHEREAS, there exists an easement granted to Humble Pipe Line Company,
as recorded in Volume 227, pages 346 and 347, Deed Records of Nueces County,
Texas, said easement previously being assigned to the City of Corpus Christi
as recorded in Volume 1319, page 249, Deed Records of Nueces County, Texas,
said portion of pipeline easement to be closed being located across the
North one half of Lot 25, Section 18, Flour Bluff & Encinal Farm Garden
Tracts; and -
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement, provided the owner
furnishes an alternate easement for the 4 -inch gas pipeline in the easement:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the hereinafter more fully described portion of
easement, previously granted to Humble Pipe Line Company, as recorded in
Volume 227, pages 346 and 347, Deed Records of Nueces County, Texas, and
previously assigned to the City of Corpus Christi as recorded in Volume 1319,
page 249, Deed Records of Nueces County, Texas, be and the same is hereby
closed for public use and every municipal purpose, said portion of easement
to be abandoned being described as follows: -
Being the North one-half (1/2) of Lot 25, Section 18,
Flour Bluff & Encinal Farm & Garden Tracts Subdivision,
situated in Nueces County, Texas.
Such abandonment is conditioned, however, upon the owner furnishing an
alternate easement for the four -inch gas pipeline in the easement.
SECTION 2. If for any reason any section paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid
or uncontitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause,

phrase, word or provision of this ordinance, for it is the definite intent
of this City Council that every section, paragraph, subdivision, clause,
phrase, word or provision thereof be given full force and effect for its'
purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid portion of easement
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and
the Mayor, having declared that such emergency and necessity exist, having
requested the suspension of the Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this the 17441( day of February, 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
