HomeMy WebLinkAbout16031 ORD - 02/11/1981' AN ORDINANCE AUTHORIZING THE CITY• MANAGER TO EXECUTE A RELEASE TO THE RIGHT OF REVERSION AS CONTAINED IN SPECIAL WARRANTY DEED DATED OCTOBER 23, 1952, AND AMENDED ON OCTOBER 22, 1954, RELATING TO THE CONSTRUCTION OF THE MAYFLOWER HOTEL ACROSS A PREVIOUSLY CLOSED DEDICATED ALLEY ALONGSIDE LOTS 1 THROUGH 4 AND 9 THROUGH 12, BLOCK 72, BEACH PORTION OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, ALL AS MORE FULLY SET FORTH IN THE RELEASE, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a Release to the right reversion as contained in Special Warranty Deed dated October 23, 1952, and amended on -October 22, 1954, relating to the construction of the Mayflower Hotel across a previously closed dedicated alley alongside Lots .1 through 4 and 9 through 12, Block 72, Beach Portion of the City of Corpus Christi, Nueces County, Texas, all as more fully set forth in the Release, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to execute the aforesaid Release at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordi- nance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the // day of February, 1981. BRUCE AYCOCK, CITY ATTORNEY orney TH CITY OF CORPUS CHRISTI, TEXAS RELEASE STATE OF TEXAS § COUNTY OF NUECES § This Release is made this day of 1981 by the City of Corpus Christi, Texas, a municipal corporation, organized and existing under and by virtue of the laws of the State of Texas, of Nueces County, Texas, acting herein by and through its duly authorized City Manager (hereinafter the "City"). WHEREAS, by a Special Warranty Deed dated October 23, 1952 and recorded in Volume 570, Page 526 of the Deed Records of Nueces County, Texas, the City conveyed to B. C. & W. Company, Incorporated, a Texas corporation, (hereinafter "Grantee") the real property located in Nueces County, Texas and more particularly described on Exhibit "A" attached hereto (hereinafter the "Property"); and WHEREAS, said Warranty Deed provided that the Property would revert to the City if the Grantee failed to construct a hotel upon the real property located in Nueces County, Texas and more particularly described on Exhibit "B" attached hereto; and WHEREAS, by a document dated September 22, 1954 and recorded in Volume 659, Page 113 of the Deed Records of Nueces County, Texas, the City and the Grantee agreed that the time limit for the construction of said hotel would be extended until October 22, 1955; and WHEREAS, the construction of said hotel was in fact• completed prior to October 22, 1955; NOW, THEREFORE, in consideration of the premises, the City does hereby release and discharge its right of reversion with respect to the Property. £Xi'.
