HomeMy WebLinkAbout16094 ORD - 03/04/1981ikh:3-4-81;lst AN ORDINANCE • AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLU- TION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE N0. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.28, SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND,. WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING DESCRIBED AS CORPUS CHRISTI INDUSTRIAL DEVELOPMENT DISTRICT AREA NO. 2 NUECES COUNTY, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendment to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wish- ing to appear and be heard were heard, to consider the same before the City .Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on March 4, 1981, at Special Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1).That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "I-3" Heavy Industrial District should be granted to the tract of land consisting of approximately 6.65 square miles of land, being described as generally north of Highway 44, south of Swetlick Road and south of the north boundary of CCPC, west of the present city limits and east of Callicoatte Road, in Nueces County, Texas; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning of "I-3" Heavy Industrial District be granted to the aforesaid described and hereinafter more fully described parcel or tract of land; and MIGRJFJLMED. 166911 'SEP Z 7 i-84 WHEREAS, by motion duly made, seconded and carried, it was decided • by the City Council that to approve the hereinafter set forth amendment would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and particularly as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the change hereinafter set.out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31-5, by adding a new subsection, 31-5.28, said new subsection to hereafter read as follows, such zoning classi- fication of the hereinafter described property to be effective upon annexa- tion: "Section 31-5.28 The following described tract of land shall be zoned and classified 'I-3' Heavy Industrial District: Corpus Christi Industrial Development Area No. 2 Lands within Nueces County, Texas, outside the city limits of the City of Corpus Christi and generally on the south by the existing north right-of-way line of State Highway No. 44, on the west by the east right-of-way line of Farm to Market Road 1694 (Callicoatte Road), from State Highway No. 44 to Swetlick Road (County Road 44) and on the north by the south right-of-way line of Swetlick Road from Farm to Market Road 1694 to Farm to Market Road 24 (Violet Road) and on the east right-of-way of Farm to Market Road 24 from Swetlick Road to the north property line of CCPC extended westerly to Farm to Market Road 24, and on the north property line of CCPC extended from Farm to Market Road 24 to and along the north property line of CCPC and extended easterly to the present city limit line, and along the present city limit line to the north right-of-way line of State Highway 44." SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. -2- SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making the aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effe t from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of March, 1981.
