HomeMy WebLinkAbout16095 ORD - 03/04/19810--.3Kh:3-4-81;Ist AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLU- TION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.29, SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING DESCRIBED AS TRACTS A AND 8, LOCATED NORTH OF THE EXTENSION OF CEDAR PASS DRIVE (COUNTY ROAD 26) AND WEST OF EVERHART ROAD, IN NUECES COUNTY, TEXAS; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendment to the text of the.Zoning Ordinance of the City of Corpus Christi; and . WHEREAS, public hearing was held at which hearing all persons +wish- ing to',appear and be heard were heard, to consider the same before the City Counc,ii.of.the City of Corpus Christi, in accordance with proper notice to - 'a..... "c) e the public, said public hearing having been held on March 4, 1981, at Special A , CouncilMeeting,of the' City.` Council in the City Council Chambers of_the City ..yam. Hall ;in -the City of Corpus Christi; and the City Council further finds as follows: - (1) That the Planning Commission of the City of Corpus Christi has found -the proposed change in zoning is in the public interest and within' the ' purpose of the zoning ordinance; and, that permanent zoning of "R-2" Multiple Dwelling District should be granted to Tracts A and B, consisting'of approxi -- mately 3.50 acres and 22.3 acres, more or less, respectively, said tracts -being out of,.Section 11, Bohemian Colony Lands,A n Nueces County, Texas,, more fully described hereinafter; 4 , (2) That the agreement for the contractual annexation of the land T described herein to the City of Corpus Christi does"not coqain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning of "R-2" Multiple Dwelling District be granted to the aforesaid described and hereinafter more fully described 4 parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would 16095 SII ILMS LMED SEP 2 719841 serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565, et seq of the Ordinance and Resolution Records, as amended from time to time, and particularly as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the change hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordi- nance of the City of Corpus Christi, Section 31-5, by adding a new subsection, 31-5.29, said new subsection to hereafter read as follows, such zoning classi- fication of the hereinafter described property tobe effective upon annexation: "Section 31-5.29 The following described tracts of land shall be zoned and classified 'R-2' Multiple Dwelling District: Tract A Being a 3.50 acre tract, more or less, in Lot 3, Section 11, Bohemian Colony Lands, Nueces County, Texas: BEGINNING at the intersection of the centerline of Everhart Road and County Road 1,26 for the Southeast corner and Point of Beginning of this tracts THENCE North 61'32' West with the centerline of County Road 1,26 a distance of 280' more or Iess, to the Southwest corner of this tract THENCE North 28°28' East 525' more or less, to the Northwest corner of this tract; THENCE South 72' East 280', more or less, to the -centerline of Everhart Road for the Northeast corner of this tracts THENCE South 29° West along said'centerline 575', more or less, to the POINT OF BEGINNING. Tract B Being a 22.3 acre tract, more or less, in Lots 3 and 4, Section 11, Bohemian Colony Lands in Nueces County, Texas: BEGINNING at a point in the centerline of County Road 1,26 for the Southeast corner and Point of Beginning of this tract whence the intersection of the center- line of Everhart Road bears South 61°32' East along said centerline 290', more or less; THENCE North 28'28' East 175' more or less, to a corner; THENCE North 61°32' West 1,600', more or less, to a corner; -2- THENCE South 28°28' West 145', more or less, to the proposed Northeast right- of-way line of County Road #26 and a corner of this tract; • TNENCE North 61°32' West along said right-of-way Iine 150', more or less, to a corner; THENCE North 28°28' East 310', more or less, to a corner; THENCE North 42° West 560', more or less, to a corner; THENCE North 62°32' West 780', more or less, to the most Northerly corner of this tract; THENCE South 28°28' West 530', more or less, to the centerline of County Road #26, the most Westerly corner of this tract; THENCE South 62°32' East along said centerline 3,000', more or less, to the . POINT OF BEGINNING. - SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of Corpus Christi, Texas, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making the aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emer- gency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on thea date of its introduc- tion and take effect and be in full force and effect /rrom and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ATTEST: �i1 e ty SecretarY MAYOR APPROVED: 4th DAY OF MARCH, 1981: J.
