HomeMy WebLinkAbout16107 ORD - 03/11/1981AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD. IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLU- TION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY AMENDING SECTION 31-5 BY ADDING "THERETO A NEW SUBSECTION, TO BE NUMBERED -31-5.27, SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING DESCRIBED AS CORPUS CHRISTI INDUSTRIALDEVELOP- MENT DISTRICT AREA NU. 1, CONTAINING 15.52 SQUARE MILES, NUECES COUNTY, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendment to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wish ing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on March 4, 1981, at Special Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1). That the Planning Commission of the City of Corpus Christi hasfound the proposed change in zoning is in the public interest and, within thepurpose of the zoning ordinance; and, that permanent zoning of "1-3 Heavy Industrial District should be granted to the tract of land consisting of approximately 15.52 square miles, generally north of IH -37, west of Corpus. Christi Beach; south of the Nueces Bay and the Nueces River, and east of the Allison Treatment Plant, in Nueces County, Texas; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, andthat such contract contains no reference to zoning; (3) That .the permanent zoning of "I-3" Heavy Industrial District be granted to the aforesaid described and hereinafter more fully described parcel or tract of land; and WHEREAS, by motion duly made, seconded and carried, it` was decided by the City Council that to approve the hereinafter set forth amendment would idiraallA44 1617 NEP 2' f tlb i serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9 pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and particularly as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the change hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordi- nance of the City of Corpus Christi, Section 31-5, by adding a new subsection, 31-5.27, said new subsection to hereafter read as follows, such zoning classi- fication of the hereinafter described property to be effective upon annexation: "Section 31-5;27 The following described tract of land shall be zoned and classified 'I -3k Heavy Industrial District: Corpus Christi Industrial Development Area No. 1 Lands within Nueces County, Texas, outside the city limits of the City of Corpus Christi and generally on the south- west by the existing northeast right -of -.way of Interstate Highway 37, and bounded on the north by the south shoreline of Nueces River and Nueces Bay, on the west by the east right, -of -way of Carbon Plant Road (County Road 558) from Interstate Highway 37 to the Nueces River." SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making the aforesaid change for the purpose of maintaining at all times a comprehensive zoning - 2 ordinance for the City of Corpus Christi creates a public emergency and an im th in erative public necessity requiring the suspension of the Charter rule t no ordinance or resolution shall be passed finally on the date of its roduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the // day of March, 1981.
