AN ORDINANCE
CLOSING AND ABANDONING A 20 -FOOT WIDE ALLEY IN BLOCK 6,
CORPUS BEACH HOTEL ADDITION AS FILED IN VOL. 1, PAGE 51,
MAP RECORDS, NUECES COUNTY, TEXAS, BEING FROM BRIDGEPORT
AVENUE TO BREAKWATER AVENUE; PROVIDING FOR A QUITCLAIM
RELEASE FROM THE OWNER OF LOT 125, BLOCK 6, CORPUS BEACH
HOTEL ADDITION TO THE OWNER OF LOT 132, BLOCK 6, CORPUS
BEACH HOTEL ADDITION, FOR A 3 -INCH BY 50 -FOOT STRIP OF
LAND ALONG THE WEST CENTERLINE OF SAID ALLEY BETWEEN
LOTS 132 AND 125, AS HEREINAFTER MORE FULLY DESCRIBED;
PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing concern-
ing the closing of a public alley situated in Block 6, Corpus Beach Hotel
Addition as filed in Vol. 1, page 51, Map Records of Nueces County, Texas,
being from Bridgeport Avenue to Breakwater Avenue, was given by publication and
mail to the last known addresses of the property abutting the alley proposed
to be closed and within 450 feet of the area to be closed, and thereafter,
pursuant to said notice, public hearing was held at Regular Council Meeting
by the City Council of the City of Corpus Christi on February 25, 1981, in
accordance with the provisions of the City Charter; and
WHEREAS, it has been determined by the City Council after such
hearing that it would best serve the public convenience and necessity to
close the alley within the limits hereinafter set forth use as a public alley,
subject to providing for a quitclaim release from the owner of Lot 125,
Block 6, Corpus Beach Hotel Addition to the owner of Lot 132, Block 6, Corpus
Beach Hotel Addition, for a 3 -inch by 50 -foot strip of land along the west
centerline of said alley between Lots 132 and 125:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS;
SECTION 1. That the public alley in Block 6, Corpus Beach Hotel
Addition as filed in Vol. 1, page 51, Map Records of Nueces County, Texas,
being from Bridgeport Avenue to Breakwater Avenue,be closed and abandoned
to the abutting property owners, subject to execution of a quitclaim release
from the owner of Lot 125, Block 6, Corpus Beach Hotel Addition to the owner
of Lot 132, Block 6, Corpus Beach Hotel Addition, for a 3 -inch by 50 -foot
strip of land along the west centerline of said alley between Lots 132 and
125, as more fully described, to -wit:

A strip of land three inches (3") wide along its entire
length, running roughly Northwest to Southeast a distance
of Fifty feet (50'), and located between 1) the line divid-
ing into equal halves the twenty -foot (20') wide alley
running roughly Northwest to Southeast down the center of
Block Six (6), Corpus Beach Hotel/Brooklyn Addition, in
Corpus Christi, Nueces County, Texas; 2) a line at all
points three inches (3") distant from, and exactly parallel
to, the line in number 1 herein above; 3) the line which
divides Lot 125, Block 6, Corpus Beach Hotel/Brooklyn
Addition, Corpus Christi, Texas, and; 4) the line dividing
Lots 125 and 132, Block 6, Corpus Beach Hotel/Brooklyn Addition,
Corpus Christi, Texas from Bridgeport Street in Corpus Christi,
Nueces County, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision,clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
or provision hereof be given full force and effect for its purpose.
SECTION 3. The fact that the public convenience and necessity would
be better served by the closing of the hereinabove described portion of
alley creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall be
passed finally -on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and
the Mayor, having declared that such emergency and necessity exist, having
requested the suspension of the Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
