HomeMy WebLinkAbout16160 ORD - 04/01/1981AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF THE CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING OF THE FOLLOWING TRACTS AS MORE FULLY SET FORTH: TRACT "A", which includes Lots 1, 2, 5 through 9, Block 15; Lots 10, 11 and 12, Block 16; all •of Block 30; Lots 3, 4, 9 through 12, Block 31; Lots 1 through 4, Block 41; Lots 1 through 6, Block 42; Lots 1, 2, 7, 9, 14 through 17, Block 47-; Lots 1, 2, 3, 4 and 6, Block A, Bluff Addition; Lots 4 through 9, Block 7, Central Wharf and Warehouse Addition and two unplatted areas described hereinafter by metes and bounds; from "I-2" Light Industrial District, "AB" Professional Office District and "A-2" Apartment House District to "6-5" Primary Business District; TRACT "B", which includes a portion of Lot M, Blucher Arroyo Tract and two unplatted areas -described by metes and bounds, hereinafter set forth; from "I-2" Light Industrial District and "A-2" Apartment House District to "B-4" General Business District; and TRACT "C", which includes two unplatted areas described hereinafter by metes and bounds, from "I-2" Light Indus -- trial District to "A-2" Apartment House District; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City- Council its reports and recommendations concerning the application of The City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Councifof the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, April 1, 1981 , at Reeular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would 16160 OFILMED OSP 2 7 795?d best serve public health, necessity and convenience and the general welfare .of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. SECTION 2. That the zoning of Tract A be and the same is hereby changed from "I-2" Light Industrial District, "AB" Professional Office District and "A-2"_Apartment House District to "8-5" Primary Business District, said Tract A being more fully described as follows: Lots 1, 2, 5 through 9, Block 15; Lots 10, 11 and 12, Block 16; all of Block 30; Lots 3, 4, 9 through 12, Block 31; Lots 1 through 4, Block 41; Lots 1 through 6, Block 42; Lots 1, 2, 7, 9, 14 through 17, Block 47; Lots 1, 2, 3, 4 and 6, Block A, Bluff Addition; Lots 4 through 9, Block 7, Central Wharf and Warehouse Addition; and Being a tract of land containing 0.57 acre more or less; this lot is not platted but is known as Lot D, Block A, Bluff Portion according to Tax Records and more specific- ally designated in Tax Assessors Map No. 17, Nueces County, Texas; BEGINNING at the Northeast corner of Block 1, Mussett Addition as showm..on -plat recorded in Book A, Page 16, Nueces County Plat Records, Nueces County, Texas, said point also being the East corner of Block 1, Paul. Court Addition as -shown on plat recorded in Book A, Page 10, Nueces County Plat Records, Nueces County, -Texas, for the Northwest corner of the tract herein described; THENCE in a southerly direction along the East boundary line of Block 1, Mussett Addition 185 feet more or less, to its intersection with, the present --North - right-of-way line of Blucher Street for the Southwest corner of this tract;_ TP.ENCE Northeast along the present North right-of-way line of Blucher Street 170 feet more or less, to its intersection with the present West right-of-way line - of Waco Street for the Southeast corner of this tract; . THENCE in a northerly direction along the present West right-of-way line of Waco Street 148 feet more or less, to a corner, the point of intersection of the present West right-of-way line of Waco Street and the easterly extension of the North boundary line of the aforementioned Block 1, Paul Court *Addition, for the Northeast corner of this tract; THENCE in a westerly direction along the easterly extension of the North boundary line of Block 1, Paul Court Addition 150 feet more or less, to the POINT - OF BEGINNING. and -2- Description of 0.747 acres of unrecorded land situated in Nueces County, - Texas. BEGINNING at the east corner of a 0.735 acre tract more particularly described in Deed Volume 1388, page 786, Nueces County Deed Records, said point being on the west right-of-way line of Carrizo Street, for the northeast corner of the tract herein described; THENCE S00°43'20" W along said west right-of-way line a distance of 113.98' more or less, to its intersection with the north right-of-way line of Kinney Street for the southeast corner of this tract; THENCE S80°46'00" W along said north right-of-way line 349.64' more or less, to its intersection with the east right-of-way line of Waco Street for .the northwest corner of this tract; THENCE N16°00'00" W along said east right-of-way line a distance of 67.96' more or less, to"its intersection with the southwesterly extension of the south boundary line of the aforementioned 0.735 acre tract for the northwest corner of this tract; THENCE N74°00'00" E along said southwesterly extension at 135' more or less, pass the southernmost corner of the aforementioned 0.735 acre tract and continuing along the south boundary line of said 0.735 acre tract, a distance . in all of 380.00 feet more or less, to the POINT OF BEGINNING. That the zoning of Tract B be and the same is hereby changed from "I-2" Light Industrial District and "A-2" Apartment House District to "B-4" General Business District, said Tract B being more particularly described as follows: Being a 0.2824 acre tract of land more or less outof a 0.56 acre tract and a 0.70 acre tract recorded in Deed Records, Vol. 921, page 120, Nueces County Deed Records, Nueces County, Texas, and Lot M, Blucher Arroyo Tract as shown on plat of record in Vol. 26, page 20, Nueces County Plat Records, Nueces County, Texas and further described by metes and bounds as follows: BEGINNING at the Northwest -corner of the 0.56 acre tract on the South right-of-way line of Blucher Street for the Northwest corner of the tract here -- in described; THENCE S16°E along a line, the common West boundary line of the -afore- mentioned 0.56 acre tract and the 0.70 acre tract, at 85.50 feet more or less, pass the Southwest corner of said 0.56 acre tract (said corner also being the Northwest corner of the 0.70 acre tract) a distance in all of 95.00 feet more or less, to a point, the intersection of said ?,Text boundary line and the south-- westerly extension of the South boundary line of the aforementioned Lot M, Blucher Arroyo Tract for the Southwest•corner of the tract herein described; THENCE N74°E across the 0.70 acre tract along the southwesterly extension of South boundary line of Lot ?t, Blucher Arroyo Tract, at 10.00 feet more or less, pass the Southwest corner of Lot M, a distance in allof100.00 feet more or less, to a point, the westerly Southeast corner of Lot M for the westerly Southeast corner of the tract herein described: THENCE N16°N along the northwesterly offset on the'South boundary line of Lot M, a distance of 9.50 feet more or less, to a point, the inner corner of. Page 20, _Nueces County Plat Records and such beginning point being the Northeast cornerofthe tract herein described: Thence S 16° E along a line, the common West boundary line of the aforementioned 0. 56 acre tract and the tract herein described, at 190.50 feet to the southwest corner of a 0. 7035 acre tract recorded in Volume 921, Page 120, Nueces County Deed Records, Nueces County, Texas, for a point for corner; Thence N 74° E along the south boundary line of said 0. 7035 acre tract 57_ 75 feet more or less to the Northwest corner of Lot K, Blucher -Arroyo Tract as recorded in Volume 27, Page 74, Nueces County Plat Records, Nueces County, Texas,, for a point' for corner; Thence S 16° E along the west boundary line of Lot K and its extension for a distance of 231.03 feet more or less to the north boundary of a 0. 337 acre tract -recorded in Volume 1388, Page 786, Nueces County Deed Records, for a point for corner. Thence 5 74° W along the North boundary line of the aforementioned 0. 337. acre tract 22. 69 feet more or less to a point for corner; Thence S 16° E along the common West boundary line of the aforementioned 0. 337 acre tract and a 0. 735 acre tract recorded in Volume 1388, page 786, Nueces County Deed Records for a distance of 165 feet more or less, to a point on the South boundary line of the original 8 acre Blucher Tract for the Southeast corner of the Tract herein described; Thence 5 74° W along the aforementioned original 8 acre Blucher Tract for a distance of 135 feet more or less to a point on the East right-of-way line of Waco Street, such point also being the Southwest corner of the Tract herein described; Thence N 16° W along the East right-of-way line of Waco Street for a distance of 586. 53 feet more or less to the Southeast corner of the right-of-way at the inter- section of Waco Street and Blucher Street for the Northwest corner of the Tract herein described; Thence N 74° W along the South Right-of-way line of Blucher Street 100. 02 feet more or less, to the point of Beginning. -4- That the zoning of Tract C be and the same is hereby changed from "I-2" Light Industrial District to "A-2" Apartment House District, said Tract C being more fully described as follows: Being a 0.1243 acre tract of land, more or less, out of 0.7035 acre+ unplatted tract recorded in Deed Records of Nueces County, Texas, Vol. 921, page 120, and further described by metes and bounds as follows: BEGINNING at a point on the West boundary line of said unplatted tract recorded in Deed Volume 921, Page 120, the intersection of said West boundary line and the southwesterly extension of the South boundary line of -Lot M, Blucher Arroyo Tract, as shown in Volume 26, Page 20, Nueces County Plat Records, Nueces County, Texas, for the Northwest corner of the tract herein described;. THENCE S16°E along the West boundary line of said unplatted tract 95.50 feet more or less, to its Southwest corner for the. Southwest corner of the tract herein described; THENCE N74°E along the South boundary line of said unplatted tract -57.75 feet more or less, to a point common with the Northwest corner of Lot_K, Blucher Arroyo Tract as shown in Volume 27, Page 74, Nueces County Plat Records, Nueces County, Texas for the Southeast corner of the tract herein described; THENCE N16°W along the northwesterly extension of the West boundary line of the aforementioned Lot K, Blucher Arroyo Tract, 95.50 feet more or less, to a point on the South boundary line of the aforementioned Lot M, Blucher Arroyo Tract for the Northeast corner of the tract herein described; THENCE S74°W along the South boundary line of the aforementioned Lot M, Blucher Arroyo Tract at 47.75 feet more or less, pass the Southwest corner of said Lot M, and continuing along the southwesterly extension of the South boundary line of said Lot M, across said unplatted tract recorded in Deed'Voluane _- 921, Page 120, a distance in all of 57.75 feet more or,less, to a point on the West boundary line of said unplatted tract for the POINT OF BEGINNING. and Being a 0.859 acre tract of land, more or less, out of a 0.337 acre tract and a 0.735 acre tract recorded in Vol. 1388, page 786, Deed Records of Nueces County,`Texas, and more particularly described by metes and bounds .as follows: BEGINNING at the northwesternmost corner of the aforementioned 0.337 -acre tract for the Northwest corner of the tract herein described; THENCE S16°E along the common West boundary line of the aforementioned 0.337_ acre tract and the 0.735 acre tract at 30 feet more or less, -pass the southwest- ernmost corner of the 0.337 acre tract, a distance in all of 165 feet mote or -less, to a point on the South boundary line of the original 8 acre Blucher Tract for the Southwest corner of the aforementioned 0.735 acre tract and the Southwest corner of the tract herein described; THENCE N74°E along the South boundary line of the aforementioned 0.735 acre tract a distance of 22.69 feet more or less, to a point, the intersection of the southeasterly extension of the West boundary line of Lot K, Blucher Arroyo Tract as shown in Plat Volume 27, Page 74, Nueces County Plat Records, Nueces County, Texas, for the Southeast corner of this tract; THENCE N16°1T across the 0.735 acre tract and along the southeasterly exten- sion of the aforementioned Lot K, Blucher Arroyo Tract, at 135 feet more or less, pass the South boundary line of the aforementioned 0.337 acre tract a distance in all of 165 feet more or less to a point on the north boundary line of said tract for the Northeast corner of the tract herein described; THENCE S74°I7 along the North boundary line of the aforementioned 0.337 acre tract 22.69 feet more or less, to the POINT OF BEGINNING. -5- SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid, change for the purpose of maintaining at all times a -comprehensive zoning- - ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on -'the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared- that such emergency and necessity exist, having requested the suspension of the -Charter rule and that this ordinance be passed finally on the date of itsintroduction- and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /& day of Qom -+-Q , 19 p .
