AN ORDINANCE
APPROVING THE TERMS OF SETTLEMENT AND AUTHORIZING THE
EXECUTION OF THE SETTLEMENT AGREEMENT AND RELATED AGREED
JUDGMENTS WHICH DEFINE THE BOUNDARIES OF THE TOWN OF
SAN PATRICIO, VALIDATE AN ANNEXATION OF THE CITY OF CORPUS
CHRISTI, AND APPORTION OVERLAPPING EXTRATERRITORIAL JURIS-
DICTION; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Council hereby finds that it is in the
public interest and specifically in the interest of the City of Corpus Christi
that there be a settlement of the long -pending lawsuits relating to the
validity of incorporation of the Town of San Patricio and relating to the
validity of that annexation by the City of Corpus Christi described in
Ordinance 10968 of the City of Corpus Christi. The Council also hereby
finds that the terms of settlement contained in the Settlement Agreement
attached hereto as Exhibit "A" and tfie two Agreed Judgments attached
hereto as Exhibits "B" and "C" are reasonable and are in the public interest
and specifically in the interest of the City of Corpus Christi.
SECTION 2. That the City Manager and the City Attorney are hereby
directed and authorized to execute all documents and do all other acts
necessary to complete, finalize and effectuate the terms of said Settlement
Agreement and said proposed Agreed Judgments, and the spirit, intent and
purpose thereof.
SECTION 3. The necessity that this settlement be completed and
effectuated as quickly as possible in order to end the lawsuits now pending,
in order to define the boundaries of municipal jurisdictions, and in order
to resolve the existing conflict between neighboring municipalities creates
a public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally on
the date of its introduction but that such ordinance or resolution shall be
read at three several meetings of the City Council, and the Mayor, having
declared that such emergency and necessity exist, having requested the suspen-
sion of the Charter rule and that this ordinance be passed finally on the

date of its introduction and take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this thelat

SETTLEIMENT AGREEMENT '
The Parties hereto intend by this Settlement Agreement to resolve
all matters in controversy in the lawsuits described herein. Upon
execution by all Parties, this Agreement will be presented to the
presiding Judge in each of the Courts in which the described lawsuits
are pending and the Courts are requested to sign and have entered a
final judgment adopting and incorporating this Settlement Agreement.
II
1. The Causes of Action to which this Settlement Agreement
relates are the following:
(a) Cause No. 15,776 in the District Court for the 36th
Judicial District, San Patricio County, Texas; styled State of Texas
Ex Rel Lonnie Glasscock, III, v. City of Corpus Christi, Et Al. .
(b) Cause No. 115,034-B in the District Court for the
117th Judicial District, Nueces County, Texas; styled State of Texas
Ex Rel City of Corpus Christi v. Percy A. Hartman, Et Al.
(c) Cause No. 115,039-F, originally filed in the District
Court for the 214th Judicial District, Nueces County, Texas, styled
City of Corpus Christi v. Percy A. Hartman, Et Al, subsequently trans-
ferred to the District Court for the 117th Judicial District, under
the consolidated cause number 115,034-B.
2. The Parties to this Agreement are the State of Texas, by
and through the County Attorney of Nueces County and by and through
the District Attorney of San Patricio County; the City of Corpus
Christi, Texas; Percy A. Hartman, Individually, and in his official
capacity as County Judge of San Patricio County; M. L. Baldeschwiler,
Individually, -and -in his official capacity as Election Judge and
Presiding Officer at the Incorporation Election of the proposed Town
of San Patricio; the persons -who signed the "Application for Incor-
poration as a Town" as alleged in Cause No. 115,034-B, referred to
in that Cause as the "Incorporators of the Town of San Patricio";
Lonnie Glassock, III; _and the Town of San Patricio, to whatever
extent it may exist as a town, whether de jure or de facto.
3. The Parties hereby stipulate and agree that the following
persons, who are named in Cause No. 15,776 as Parties Defendant,
were named in their official capacities as Mayor and Councilmen of
the City of Corpus Christi, are no longer officials of the City of
Corpus Christi, and are hereby nonsuited and dismissed as parties:
Ronnie Sizemore, Mayor, and Charles A. Bonniwell, Roberto Bosques, M. D.,
Rev. Harold T. Branch, Thomas V. Gonzales, Gabe Lozano, Sr. and J.
Howard Stark, Councilmen.

ANNEXATION BY THE CITY OF CORPUS CHRISTI
The Parties hereby stipulate and agree as follows:
(a) On the 14th day of June 1972 the City of Corpus Christi
began annexation proceedings, and on the 18th day of July 1972, by
Ordinance No. 10968, completed annexation proceedings relating to the
following described property:

and the same is hereby annexed to the City of Corpus Christi:

Texas, as set out by Area A, City Ordinance
No. 10002, dated the 18th day of November,
1970; said point being the intersection of
the East boundary line of Tract 5, Riverside
Subdivision of the Section No..6 of the
Wade Riverside Pastures as recorded in Volume
A, page 48, Map Records, Nueces County, Texas,
and the right bank of State-owned river bed
of the Nueces River for the beginning corner
of the tract herein described;
Thence upstream in a general westerly direction
with the right bank of State-owned river bed
of said Nueces River, to its intersection
with the east boundary line of Share 1, C. C.
Wright Partition in the Vicente Lopez de Herrera
Grant, said point being an airline distance of
5.0 miles from said point of beginning;
Thence in a northerly direction with the -
northerly extension of the East line of said
Share 1, across the Nueces River, to its inter-
section with the left bank of State-owned
river bed of said Nueces River for a corner
of the tract herein described;
Thence downstream in a general easterly
direction with the left bank of State-owned
river bed of said Nueces River, to its
intersection with the northerly extension of
the east line of said Tract 5, Riverside
Subdivision, said point being an airline dis-•
tance of 5.0 miles from the corner described
on previous call for a corner of the tract
herein described;
-Thence S. 10° 00' w. with the northerly ex-
tension of the east line of said Tract 5,
Riverside Subdivision, across the Nueces
River, to the point of -beginning.
Containing 30.5 acres of land, more or less.
(b) All procedures requisite for said annexation were
completed.
(c) All of the annexed property at the time of annexation
was used for -public purposes, owned by governmental agencies, or
dedicated to a public use, as a matter of fact; and came within the
meaning of those terms as used in Article I, Paragraph 3 of the
Charter of the City of Corpus Christi. _
(d) The annexed property immediately prior to its annexation
abutted upon the city limits of the City of Corpus Christi and the en' •
tire area annexed was contained within the extraterritorial jurisdiction
of the City of Corpus Christi as that jurisdiction existed immediately
prior to the annexation.
(e) The Parties hereto pray that the Court enter final
judgment decreeing that the annexation was in all respects valid and
that since the 18th day of July 1972, the area included within the
Annexation Ordinance, as described in Paragraph (a) above, has been
included within the city limits of the City of Corpus Christi for all
purposes.
(f) All of the Parties hereto consent to the annexation by
the City -of Corpus Christi of the_above-described property_and relin---
auish any claim to ttie contrary.

IV
INCORPORATION OF THE TOWN OF SAN PATRICIO
The Parties hereby stipulate and agree as follows:
(a) On the 7th day of July 1972, proceedings began for the
incorporation of the proposed Town of San Patricio and on the 18th day
of July 1972, the incorporation of the Town of San Patricio was
approved by election.
(b) The description of the boundaries of the Town of San
Patricio as proposed in the Notice of Election includes a portion of
the Nueces River and is in conflict with the area annexed by the
City of Corpus Christi, as described in Section I above.
(c) No part of the bed or banks of the Nueces River were
part of the townsite.of San Patricio or used or usable for town pur-
poses of the Town of San Patricio.
(d) The townsite of the Town of San Patricio lies northerly
of the North.bank of the Nueces River, being generally within San
Patricio County_..
(e) --The description of the boundaries of the townsite of
the Town of San Patricio as proposed in the Notice of Election includes
land in Nueces County lying southerly of the Nueces River, which land
is separated from -the townsite by the Nueces River and is not contiguous
with the townsite as described in Paragraph (d) above.
(f) Included herein as Exhibit "A" is a description of the
land which was properly includable within the boundaries of the Town
of San Patricio, having taken into account the matters stated in
Paragraphs (b), (c), (d) and (e) of this Part IV.
(g) -The-City of Corpus Christi consents to the incorporation
of the Town of San Patricio within, but only within, the boundaries
described in Exhibit "A", and all Parties hereby relinquish any claim
that the Town_of San Patricio includes lands in addition to those des-
cribed in Exhibit:"A"
(h) The Parties pray that final judgment be entered decreeing
that the Town of San Patricio has been a validly incorporated munici-
pality since July 18, 1972, but only within and limited to the boun-
daries described in Exhibit "A" hereof.

EXTRATERRITORIAL JURISDICTION
By the -terms of Article 970a, Texas Revised Civil Statutes,
the extraterritorial jurisdiction of the City of Corpus Christi extends
5 miles from its city limits; the extraterritorial jurisdiction of the
Town of San Patricio would extend 1/2 mile from its city limits. As
a result of the annexation described in Part III hereof and the incor-'
poration described in Part IV hereof, those territories would overlap.,,
Therefore, it,is.agreed that the •overlapping area will be apportioned,•
as follows:.
(a) The Town of San Patricio shall have extraterritorial
jurisdiction over all that territory provided to it by Article 970a
which lies northerly of the north bank of the Nueces River, and shall
have no extraterritorial•jurisdiction over any of the bed and banks of
the Nueces River or any territory lying southerly of the Nueces River.

(b) The Town of San Patricio shall maintain in force and
effectively enforce, within its extraterritorial jurisdiction, sanitation
regulations and standards not lower or less stringent then contained in
Ordinance No. 1 of the Town of San Patricio,. adopted September 21, ,
1972.
(c) The City of Corpus Christi shall have extraterritorial
jurisdiction over all that territory provided to it by Article 970a
which lies outside the extraterritorial jurisdiction of the Town of
San Patricio as agreed to in Paragraph (a) above.

This Settlement Agreement was approved and its execution authorized
by the City Council of the Town of San Patricio.on

BOUNDARIES OF TOWN OF SAN PATRICIO
Beginning at the intersection of the east line of F. M.
Highway 666 and the south line of Tract 9 of the C. C. Smith
Subdivision of the Borden Ranch tract, the southwest corner
of said Tract 9 and the northwest corner of a 12.2 acre tract
owned by Sherman Schibler, situated in San Patricio County;
Thence in an easterly direction with the north line of
said 12.2 acre•tract, a distance of approximately 653 feet to
the northeast corner of said Sherman Schibler tract;
Thence in'a southerly direction, a distance of approxi-
mately 722 feet to the southeast corner of said Sherman Schibler
tract;
Thence in a westerly direction with the south line of said
Sherman Schibler tract, a distance of 400 feet to a point;
Thence in a southerly direction, parallel to the east line
of said F. M. Highway 666, a distance of approximately 2300 feet -

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
