AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM
TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO.
6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961,
BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY
AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION,
TO BE NUMBERED 31-5.30, SETTING FORTH ZONING CLASSIFICA-
TION ON THE DESCRIBED TRACTS OF LAND, WHEN ANNEXED TO
THE CITY OF CORPUS CHRISTI, SAID.TRACTS BEING DESCRIBED
AS TRACTS A, B AND C, IN NUECES COUNTY, TEXAS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICA-
TION; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning certain amendments to the text of
the Zoning Ordinance of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons wish-
ing to appear and be heard were heard, to consider the same before the City
Council of the City of Corpus Christi, in accordance with proper notice to
the public, said public hearing having been held on April 1, 1981, at Regular
Council Meeting of the City Council in the City Council Chambers of the City
Hall in the City of Corpus Christi; and the City Council further finds as
follows:

That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-4" General
Business District on Tract A (10.25 acres); "B-1" Neighborhood Business
District on Tract B (8.05 acres) and "A-1" Apartment District zoning on
Tract C (19.85 acres) should be granted to the tracts of land consisting of
a total of approximately 38.15 acres out of Lots 1, 2, 3 and 4, Section 20,
Flour Bluff and Encinal Farm and Garden Tracts, in Nueces County, Texas;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels or
tracts of land; and

WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL. OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9,
pages 565 et seq of the Ordinance and Resolution Records, as amended from
time to time, and particularly as amended by Ordinance No. 6106, passed and
approved by the City Council on the 29th day of March, 1961, be and the same
is hereby, amended by making the change hereinafter set out.
SECTION 2. There is hereby amended Article 31 of the Zoning Ordi-
nance of the City of Corpus Christi, Section 31-5, by adding a new subsection,
31-5.30, said new subsection to hereafter read as follows, such zoning classi-
fication of the hereinafter described property to be effective upon annexation:
"Section 31-5.30 The following described-trac- of land shall
be zoned and classified as follows:
Tract A: Being a 10.25 acre parcel or tract, more or
less, of land out of Lots 1 and 2, Section 20,
Flour Bluff and Encinal Farm and Garden Tracts,
a map of which is recorded in Volume A, pages 41,
42, and 43, Map Records of Nueces County, Texas:
BEGINNING at a point on the South right-of-way line of Saratoga Boulevard
for a corner of this tract from which corner the Northwest corner of said Lot 1,
Section 20, bears North 28°57'30" East 60.00 feet to a point on the centerline
of Saratoga Boulevard, same being the North boundary line of said Lot 1, Section
20, and with said centerline North 61°02'30" West 220.00 feet, more or less;
THENCE South 61°02'30" East with the South right -of -wag line of Saratoga Boule-
vard 670.00 feet, more or less, to a point for the Northeast corner of this tract;
THENCE South 28°57'30" West leaving said right-of-way line, 535.00 feet, more
or less, to a point for the Southeast corner of this tract;
THENCE North 61°02'30" West, 872.23 feet, more or less, to a point for the
Southwest corner of this tract;
THENCE North 28°57'30" East, parallel with the centerline of County Road No. _
13 thereof and 40.00 feet distant therefrom, measured at right angles thereto,
445.00 feet, more or less, to a point for a corner of this tract;
THENCE South 87°36'24" East, 201.24 feet, more or less, to the PLACE OF
BEGINNING.
shall be zoned "B-4" General Business District;
Tract B: Being a 8.05 -acre parcel or tract, more or less,
of land out of Lots 2, 3 and 4, Section 20, Flour
Bluff and Encinal Farm and Garden Tracts, a map
of which is recorded in Volume A, pages 41, 42
and 43, Map Records of Nueces County, Texas:
BEGINNING at a point on the South right -of -wag line of Saratoga Boulevard for
the Northwest corner of this tract from which corner the Northwest corner of said
Lot 2, Section 20, bears North 28°57'30" East 60.00 feet to a point on the center-
line of Saratoga Boulevard, same being the North boundary line of said Lot 2, Sec-
tion 20, and with said centerline North 61°02'30" West 289.18 feet, more or less;
THENCE South_ 61°02'30" East with the South right-of-way line of -Saratoga Boule-
vard 832.39 feet, more or less, to a point for the Northeast corner of this tract;
THENCE South 40°57'30" East, 235.41 feet, more or less, to a point for a corner
of this tract;
THENCE South 02°25'00" West, parallel with the centerline of Airline Road
thereof and 40.00 feet distant therefrom, measured at right angles thereto, 285.00
feet, more or less, to a point for the Southeast corner of this tract;
THENCE North 61°02'30" West, 1,I86.00 feet, more or less, to.a point for the
Southwest corner of this tract;
THENCE North 28°57'30" East, 326.85 feet, more or less, to the PNCE OF BE-
GINNING.
shall be zoned "B-1" Neighborhood Business District;
Tract C: Being a 19.85 acre tract_. or parcel, more or
less, out of Lots 2, 3 and 4, Section 20,
Flour Bluff and Encinal Farm and Garden
Tracts, a map of which is recorded in Vol. A,
pages 41, 42 and 43, Map Records of Nueces
County, Texas:
BEGINNING at a point on the west right -of., --way Tine of Airline Road, 40.00
feet off said centerline for the northeast corner of this tract from which corner
the northwest corner of said Lot 4, Section 20, bears south 87°35'00" -east 40.00
feet to a point on the centerline of Airline Road, and with said centerline north
02°25'00" east, 457.07 feet, more or less;
THENCE south 02°25'00" west, parallel with the centerline of Airline Road
thereof and 40.00 feet distant therefrom measureC at right angles thereto, 942..00
feet, more or less, to a point for the southeast corner of this tract;
THENCE north 61°02'30" west, 997.00 feet, more or less, to a point for the
southwest corner of this tract;
THENCE north 28°57'30" east, 470.00 feet, more or less, to a point for a
corner of this tract;
THENCE north 61°02'30" west,•239.00 feet, more or less, to a point for a
corner of this tract;
THENCE north 28°57'30" east, 130.00 feet, more or less, to a point for a
corner of this .tract;
THENCE north 61°02'30" west, 350.00 feet, -more or less, to a point for a
corner of this tract;
THENCE north 28°57'30" east, 208.15 feet, more or less, to a point for the
northwest corner of this tract;
THENCE south 61°02'30" east, 1,176.00 feet, more or less, to the point of
beginning.
shall be zoned "A-1" Apartment District."
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and effect.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as_amended from
time to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of -ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making the aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the -Mayor, having declared that
such emergency and necessity exist, having requested the_suspension of the
Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect -from and after
its passage, IT.IS ACCORDINGLY SO ORDAINED, this the ,/ day of April,

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
