CLOSING AND ABANDONING A PORTION OF A 5 -FOOT WIDE
UTILITY EASEMENT ALONG THE NORTH SIDE OF LOT 5,
BLOCK 9, WOODLAND CREEK, UNIT 11, AS SHOWN BY
PLAT RECORDED IN VOL: 44, PAGES 56 AND 57 IN MAP
RECORDS OF NUECES COUNTY, TEXAS, SAID CLOSURE
BEING A STRIP OF LAND 62.8' LONG BY 0.60' WIDE,
SUBJECT TO REPLATTING OF LOT 5; AND DECLARING AN
EMERGENCY.
WHEREAS, there exists a 5 -foot wide utility easement along the north
side of Lot 5, Block 9, Woodland Creek, Unit II, as shown by plat recorded in
Vol. 44, pages 56 and 57, Map Records of Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon a strip of land 62.8 feet long by
0.60 feet wide out of the said utility easement, subject to replatting of
Lot 5 at the owner's expense:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the more fully described strip of land 62.8 feet
long by 0.60 feet wide, out of Lot 5, Block 9, Woodland Creek, Unit II, as
shown by plat recorded in Vol. 44, pages 56 and 57, Map Records of Nueces
County, Texas, be and the same is hereby closed for public use and every
municipal purpose, subject to replatting of Lot 5 by the owner at the owner's
expense:
Being 37.68 square feet, more -or less, out of Lot 5, Block 9, Woodland
Creek Unit II, as shown by plat recorded in Volume 44, Pages 56 and 57.
in Plat Records of Nueces County, Texas, and being more particularly
described by metes and bounds as follows:
COMMENCING at the most northerly corner of said Lot 5, Block 9;
THENCE South 67°37'06" East, 28.90 feet;
THENCE South 22°22'54" West, 4.40 feet for the POINT OF BEGINNING;
THENCE South 67°37'06" East, 62.80 feet;
THENCE South -22°22'54" West, 0.60 feet;
THENCE North 67°37'06" West, 62.80 feet;
THENCE North 22°22'54" East, 0.60 feet to the POINT OF BEGINNING.

SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction,
it shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase,
word or provision hereof be given full force and effect for its purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid easement creates a
public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared that such emergency and necessity exist, having requested the sus-
pension of the Charter rule and that this ordinance be passed finally on the
date of its introduction and take effect and be in full force and effect from
and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
