HomeMy WebLinkAbout16183 ORD - 04/08/1981jkh:4-8-81;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREE- MENT BETWEEN THE CITY OF CORPUS CHRISTI AND FEDERAL EXPRESS CORPORATION FOR USE OF A PORTION OF THE INTER- NATIONAL ARRIVAL BUILDING AT THE CORPUS CHRISTI INTER- NATIONAL AIRPORT, COMMENCING MAY 1, 1981 AND TERMINATING AUGUST 7, 1981, EXTENDING THE TERMS OF THE AGREEMENT ENTERED INTO BY AND BETWEEN THE CITY AND FEDERAL EXPRESS CORPORATION BY AUTHORITY OF ORDINANCE NO. 15813, PASSED AND APPROVED BY THE CITY COUNCIL ON OCTOBER 8, 1980, EXCEPT AS SET FORTH IN THE ATTACHED AMENDED LEASE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A" AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a lease agreement between the City of Corpus Christi and Federal Express Corporation for use of a portion of the International Arrival Building at the Corpus Christi International Airport, commencing May 1, 1981 and termi- nating August 7, 1981, extending the terms of the agreement entered into by and between the City andFederal Express Corporation by authority of Ordinance No. 15813, passed and approved by the City Council on October 8, 1980, except as set forth in the attached lease agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to authorize execution of the aforesaid lease agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction'.but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of April, 1981. Marvin Townsend, by authority of Ordinance No. 15813, passed and approved by the City Council on October 8, 1980, authorized -an agreement with Federal Express Corporation for use of a portion of the Terminal Building at the Corpus Christi International Airport, said agreement to commence May 1, 1980, on a month-to-month basis; and WHEREAS, the parties to the aforesaid agreement desire to amend the aforesaid agreement as follows: 1. The City hereby agrees to rent space in the International Arrival Building at the Corpus Christi International Airport to Federal Express Corporation from May 1, 1981 through August 7, 1981. The portion to be rented is more fully described on the attached map, marked Exhibit "A", which contains .one hundred_ten (110) square feet. 2. Federal Express Corporation agrees to pay a rental in the amount of $7.65 per squarefootper year,payable monthly in the amount of $70.13, to the Airport Manager at his office at the International Airport in Nueces County, Texas.
