HomeMy WebLinkAbout16192 ORD - 04/15/1981NB 4.14.81 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A MAINTENANCE AGREEMENT WITH THE DEVELOPERS OF SOUTH SEA ISLAND SUB- DIVISION IN FLOUR BLUFF, PROVIDING FOR THE DEVELOPERS TO MAINTAIN A 400 -FOOT LONG LANDSCAPED MEDIAN AT THE ENTRANCE TO THE SUBDIVISION, ALL AS MORE FULLY SET FORTH IN THE SAID AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby author- ized to execute a maintenance agreement with the developers of South Sea Island Subdivision in Flour Bluff, providing for the developers to main- tain a 400 -foot long landscaped median at the entrance to the sub- division, all as more fully set forth in said agreement, a substantial copy of which is attached hereto, marked Exhibit "A", and made a part hereof. SECTION 2. The necessity to authorize execution of the afore- said agreement in order to effectuate the terms of the agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no or- dinance or resolution be passed finally on the date of its introduction, but that such ordinance or resolution be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, requeststhe suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage. Bluff, hereinafter called "Developers", and pertains to the perpetual maintenance of a median island in a public street known as South Sea Drive in South Sea Island Subdivision. NOW, THEREFORE, the City and Developers agree as follows: 1. Development includes an existing median -island approximately 450 L.F. in length in South Sea Drive, an entrance street to South Sea Island Subdivision, per attached EXHIBIT "A". 2. Developers will maintain all of the surface area of the island shown in EXHIBIT "A", and will grade, mow, plant, landscape, irrigate and/or otherwise assume full responsibility for caring for and preserving planting materials of all types which may he placed in the island by Developers, to .include a regular maintenance program. Signs will not be erected within the island, nor will the island be totally paved with asphalt, concrete, tile, brick or similar materia'_-: without the written approval of the City. 3. For purposes of this Agreement Developers agree that they will be jointly or singularly liable for maintenance responsibilities within the island_ 4. This Agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors, and assigns..
