HomeMy WebLinkAbout16194 ORD - 04/15/1981NB 4.14.81 ,7 AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, AS AMENDED, BY AMENDING SECTIONS 23-8, 23-9, 23-10, 23-11, and 23-72, HEALTH•AND SANITATION, BY OMITTING REFERENCES TO THE WEED AND RUBBISH CONTROL DIVISION IN THE DEPARTMENT OF PUBLIC HEALTH, AND BY GRANTING AUTHORITY TO THE CITY HEALTH OFFICER AND DI RECTOR OF NEIGHBORHOOD IMPROVEMENT TO CARRY OUT THE — PROVISIONS OF SECTION 23-50 THRU 23-73 OF THE CODE OF ORDINANCES AND ARTICLE 4436, REVISED CIVIL STA- TUTES; AND PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 23, Section 23-8 of the Code of Ordi- nances, City of Corpus Christi, 1976 Revision, as amended, be amended to read as follows: The city health officer and the director of neigh- borhood improvement shall have authority to carry into effect the provisions of sections 23-50 thru 23-73 of this Code and Article 4436, Revised Civil Statutes. SECTION 2: That Chapter 23, Section 23-9 of 'the Code of ordi- nances, City of Corpus Christi, 1976 Revision, as amended, be amended to read as follows: The city health officer and the director of neighb- borhood improvement, when carrying out the functions required by sections 23-50 thru 23-73 of this Code and Article 4436, Revised Civil Statutes, shall have full authority to take all action necessary to en- force and carry into effect the provisions of same. SECTION 3. That Chapter 23, Section 23-10 of the Code of Or- dinances, City of Corpus Christi, 1976 Revision, as amended, be amended by deleting from the first sentence of this section the words "The di- rector of the weed and rubbish control division and the employees of such division", and substituting therefor the words "The city health officer, the director of neighborhood improvement and the employees under their supervision's, and deleting from the second sentence of this section the words such director of such employees from making". SECTION 4; That Chapter 23, Section 23-11 of the Code of Or- dinances, City of Corpus Christi, 1976 Revision, as amended, be amended by deleting the words "by the weed and rubbish control division" and substituting therefor the words "pursuant to sections 23-50 thru 23-73 of this Code and Article 4436, Revised Civil Statutes." MICROFILMED 161.94 SEP 2 71984 SECTION 5: That Chapter 23, Section 23-72 of the Code of Or- dinances, City of Corpus Christi, 1976 Revision, as amended, be amended by deleting at the beginning of the first sentence of this section the words "The mayor or city health officer" and substituting therefor the words "The city health officer, or the director of neighborhood improve- ment or their duly authorized representatives,". SECTION 6. If for any reason any section, paragraph, subdi- vision, clause, phrase, word or provision of this ordinance shall be in- valid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdi- vision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision thereof be given full force and effect for its purpose. SECTION 7. Except as otherwise provided, this ordinance shall be in full force and effect after publication which publication shall be made one time by publishing in the official newspaper of the City of Corpus Christi the caption of this ordinance stating in substance the purpose of the aforesaid ordinance. SECTION 8. The necessity to amend the City Code of Ordinan- ces as hereinabove set forth creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution be passed finally on the date of its intro- duction, but that such ordinance or resolution be read at three several meetings of the City Council. The Mayor, having declared that such emergency and necessity exist, has requested that the Charter rule be suspended and that this ordinance be passed finally on the date of its introduction, and take effect and be in full force and effect from and after its passage.
