HomeMy WebLinkAbout16224 ORD - 05/06/1981AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREE- MENT WITH THE MUSIC PERFORMANCE TRUST FUNDS, 1501 ' BROADWAY, SUITE 315, NEW YORK CITY, NEW YORK, FOR TWELVE (12) SUMER CONCERTS IN 1981, R'HIQ3 WILL BE PLAYED BY THE CORPUS CHRISTI MUSICIAN'S ASSOCIATION INC., LOCAL NO. 644, ATA COMPENSATION OF FIVE HUND- RED FORTY TWO ($542) PER PERFORMANCE, NOT TO EXCEED SIX THOUSAND TIVE HUNDRED ($6500) DOLLARS IN TOTAL, FOR THE PUiyOSEAF' PROVIDING THE CITIZENS OF CORPUS CHRISTI WITUASICAL PERFORMANCES FOR THEIR BENEFIT AND ENJOYT, A SUBSTANTIAL COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED E)9-IIB,,i-T "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1.. That the City Manager be authorized to execute an agreement with the Music Performance Trust Funds, 1501 Broadway, Suite 315, New York City, New York, for twelve (12) summer concerts in 1981; which will be played by the Corpus Christi Musician's Association, Inc.,_Local No. 644, i at a compensation of Five Hundred Forty Two ($542) per performance, not to exceed Six Thousand Five Hundred ($6500) Dollars in total, for the purpose of providing the citizens of Corpus Christi with musical performances for their benefit and. enjoyment, a substantial copy of which.agreement is attached hereto and made a part hereof, marked Exhibit "A'. SECTION 2. The necessity to authorize execution of the aforesaid agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that - no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORD- INGLY SO ORDAINED, this the (Q day of ATTEST: City Secretary MAYOR THE CITY OF CORPUS CHRISTI, TEXAS ' APPROVED: • CG DAY OF MAY; 1981: no. ,,r , 1981. BRUCE AYCOCK, CITY ATTORNEY ' BY Assistant Oi.0 Attorney MICROFILMED 16224 IEP 9 n $nna, THE STATE OF TEXAS COUNTY OF NUECES f AGREEMENT KNOW ALL MEN BY THESE PRESENTS: That this Agreement, made and entered into on this the , - day of , 1981, by.and between the City of Corpus Christi, a muni- cipal corporation, hereinafter referred to as "CITY", and the Music Performance.Trust Funds, 1501 Broadway, suite 315, New York City, New York, hereinafter called "MPTF": WITNESSETH: The MPTF has agreed to provide twelve (12) concerts to be held in Cole Park Amphitheater on the following dates in 1981: 'June 7, 14, 21, and 28; July 8, 12, 19, and 26; August 2, 9 and;16; and one performance at the Texas Jazz Festival on July 4, 1981, for the benefit and enjoyment of the citizens of Corpus Christi. In consideration of providing music for these performance, the City agrees to pay the MPTF the sum of Six Thousand Five Hundred ($6,800) Dollars. Pay- ment up to the agreed sum is to be made on presentation of requests for payment sub- mitted at the end of each month at the rate of Five Hundred Forty -Two ($542) Dollars per performance held during that month. In addition to the concert funding, the City further agrees to provide use of facilities for these performance through the Park and Recreation Department. The City further agrees to provide the transportation of music stands and musical instruments before and after each outdoor concert. Transportation will be between Del Mar College and the site of the twelve (12) concerts at Cole Park. WITNESS OUR HANDS at Corpus Christi, Texas, this the day of ,1981. Paulson, Trustee Corpus Christi, Texas La day of \-1'11 , 19 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, but that such ordinance or resolution shall be read at three meetings of the City Council; I/we, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
