AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY
FOR THE ACQUISITION OF A 1.946 -ACRE TRACT OF LAND IN CON-
NECTION WITH THE GABRIEL TERRACE DRAINAGE OUTFALL PROJECT;
APPROPRIATING OUT OF THE NO. 295 STORM SEWER BOND FUND,
FOR PROJECT NO. 295-72-2, THE SUM OF $14,900, OF WHICH
$14,600 IS FOR ACQUISITION OD $300 IS FOR INCIDENTAL
COSTS RELATED TO CLOSING;; AM DECLARING AN EMERGENCY.

SECTION 1. That the City Manager be and he is hereby authorized
to execute documents necessary for the acquisition of a 1.946 -acre tract of
land in connection with the Gabriel Terrace Drainage Outfall Project from
James B. Sorenson, et al, said parcel being more particularly described as
follows: _
Description of a 1.946 acre tract of land,
40' wide out of Farm Lots 1 and 8, Section
5, Range VIII, Gugenheim and Cohn's Farm
Lots:
Beginning at -a point in the east line of
a 112_78 acre tract and 'the east line of
the northwest k of Farm Lot 1, Section 5,
Range VIII, Gugenheim and Cohn's Farm Lots,
from whence a 3/4" iron pipe in the east
line of said northwest 'y of Farm Lot 1,
Section 5, Range VIII at its intersection
with the south right-of-way line of Bear
Lane, a 60' wide road, bears N. 0' 01'.52"
W., 330.51 feet;
Thence S. 48° 50' 59" W., 917.91' to a -
point in the west line of said Farm Lot 1
and east line of Farm Lot 2, Section 5,
Range.VIII, Gugenheim and Cohn's Farm
Lots, for corner;
Thence, continuing with the common line
of Farm Lots 1 and 8, and Farm Lots 2 and
7 of said Gugenheim and Cohn's Farm Lots,
South 1223.38' to a point;
Thence S. 53° 48' 29" E., 49.56' to a point;
Thence North, parallel to and 40' east of
the common line of Farm Lots 2 and 7 and
Farm Lots 1 and,8, 1234.48' to a point;
Thence N. 48° 50' 59" E., 864.83' to a
point in the east line of the previously
mentioned northwest k of Farm Lot 1;
Thence with said east line of northwest
4 of Farm Lot 1, N. 0' 01' 52" W.,
53.09' to the point of beginning and con-
taining 1.946 acres of land, more or less.

SECTION 2. That there is hereby appropriated out of the No. 295
Storm Sewer Bond Fund, for Project No. 295-72-2, the sum of $14,900, of
which $14,600 is for acquisition and $300 is for incidental costs related
to closing.
SECTION 3. The necessity to authorize execution of the aforesaid
documents and to appropriate the sums necessary to acquire the property
described creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordi-
nance or resolution shall be read at three several meetings of the City
Council, and the Mayor or Council members, having declared that such emergency
and necessity exist, having requested the suspension of the Charter rule and
that this ordinance be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED this the 40 day of May, 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, but that such ordinance or resolution shall be read
at three meetings of the City Council; I/we, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
