HomeMy WebLinkAbout16229 ORD - 05/06/1981AN ORDINANCE CLOSING AND ABANDONING A 60 -FOOT WIDE STREET RIGHT-OF-WAY KNOWN AS ROCKFORD DRIVE, FROM OLD BROWNSVILLE ROAD TO CLIFF MAUS DRIVE; RETAINING A PORTION AS DRAINAGE RIGHT- OF-WAY, DESCRIBED BELOW AS PARCEL NO. 1, AND PROVIDING THAT THE REMAINING PORTION, MORE FULLY DESCRIBED AS PARCELS 8A, 8B, 9, 18 AND 19 AND AS SHOWN ON THE ATTACHED EXHIBIT, REVERT TO THE ADJACENT PROPERTY OWNERS; FURTHER PROVIDING FOR THE CLOSURE TO BE VOIDED SHOULD ALL AGREEMENTS, TRANS- ACTIONS AND RELATED MATTERS PERTAININR►TO THE CITY/SITTERLE PROPERTIES/SORENSON PROPERTIES, CQYVER,ED BY SEPARATE ORDINANCES, FAIL TO BE CONSUMM (D; ND DECLARING AN EMER- GENCY. }��a WHEREAS, notice ° Mr*, time andp ce for holding a hearing concern- "' ing the closing of a 60 -foot wide. street right-of-way, known as Rockford Drive, from Old Brownsville Road to Cliff Maus Drive, situated in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known address of the owners of property abutting said areas and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting of the City Council of the City of Corpus Christi on Wednesday, April 29, 1981, in accordance with the provi- sions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close and abandon a 60 -foot wide street right-of-way, known as Rockford Drive, from Old Brownsville Road to Cliff Maus Drive, retaining a portion thereof as drainage right-of-way, more fully described below as Parcel No. 1, and provi- ding that the remaining portion, described as Parcels 8A, 8B, 9, 18 and 19, revert to the adjacent property owners; provided, however, that the closure shall be voided should all agreements, transactions, and related matters per- taining to the City/Sitterle Properties/Sorenson Properties, covered by separate ordinance, fail to be consummated: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 60 -foot wide street right-of-way, known as Rockford Drive, from Old Brownsville Road to Cliff Maus Drive, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby close for public use and abandoned to the abutting property owners; however, there is hereby retained a portion as drainage right-of-way, described as follows: 16229 MICLMEJ. SEP z,1 � �4 Parcel No. 1 Beginning at a concrete monument, St. Martin's Subdivision as filed Map Records, Nueces County, Texas Thence S 89° 42' 48" W, 159.05' of this tract; Thence N 53° 48' 29" W, 100.93' of this tract; Thence N 89° 42' 48" E, 168.21' of this tract; Thence S 53° 48' 29" E, 100.93' of this tract; Thence and providing that the northwest corner of at Volume 32, page 126, to the southwest corner to the northwest corner to the northeast corner to the southeast corner S 89° 42' 48" W, 9.16' to the point of beginning, said tract containing 0.231 acres of land, more or less. the remaining portion, more fully described as Parcels 8A, 86, 9, 18 and 19, revert to the adjacent property owners: Parcel 8A Beginning at a 5/8" iron rod in the southeastright-of-way line of Old Brownsville Road, a 120' wide road from whence a concrete monument set in said line of Old Brownsville Road bears N 540 12' 32" E, 351.28'; Thence N 89° 42' 48" E corner; 410.50' to a 5/8" iron rod for a Thence S 53° 48' 29" E 50.46' to a point for a corner; Thence S 89° 42' 48" W 493.14' to a point in the south- east right-of-way line of Old Brownsville Road. Thence S 89° 42' 48" W, 570.84' to the southwest corner of this tract; Thence N 530 48' 29" W, 50.46' to the northwest corner of this tract; Thence N 890 42' 48" E, 611.61' to a point in the west line of Cliff Maus Road and the northeast corner of this tract; Thence S 0° 04' 18" W, with said west line, a distance of 30.00' to the point of beginning, said tract containing 0.407 acres of land, more or less. Parcel 19 Description of a tract of land containing 0.435' acres of land out of Lot 8, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots, as recorded at Volume A, page 53, Map Records, Nueces County, Texas. Beginning at a point in the west line of Cliff Maus Road, a 60' wide road, said point bearing N 00 04' 18" E, 30.00' from a 1" iron pipe, the northeast corner of St. Martin's Subdivision as recorded at Volume 32, page 126, Map Records, Nueces County, Texas. Thence S 89° 42' 48" W, 611.61' Thence N 530 48' 29" W, 50.46' Thence N 89° 42' 48" E, 652.38' line of Cliff Maus Road, this tract; Thence of this tract; of this tract; to the southwest corner to the northwest corner to a point in the west the northeast corner of With said west line S 00 04' 18" W, 30.00' to the point of beginning, said tract containing 0.435 acres of land, more or less. . s said parcels 8A, 8B, 9, 18, and 19 being more particularly shown on the attached exhibit; provided, however, that the closure be voided should all agreements, transactions and related matters pertaining to the City/Sitterle Properties/Sorenson Properties, covered by separate ordinances, fail to be consummated. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the hereinabove described right-of-way creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor or Council members, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance -be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 0 day of May, 1981.
