AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF GENE BRANSCOME BY AMENDING THE ZONING MAP BY CHANG- ING THE ZONING ON TRACT A FROM "I-3" HEAVY INDUS- TRIAL DISTRICT TO "A-2" APARTMENT HOUSE DISTRICT AND ON TRACT B FROM "I-3" HEAVY INDUSTRIAL DISTRICT TO "B-4" GENERAL. BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; RELEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of • Gene Branscome for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday May 6, 1981 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded - and carried, it was decided by the City Council that to approve the hereinafter. set forth amendment would_ best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the zoning of Tract A be and the same is hereby changed from "I-3" Heavy Industrial District to "A-2" Apartment House District, and that the zoning of Tract B be changed from "I-3" Heavy Industrial District to "B-4" General Business District, said Tracts A and B being more fully described as follows: TRACT A Description for a 17.65 acre tract of land out of Lots 7 and 8, Section 4, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, and further described by metes and bounds as follows: BEGINNING at a point on the West boundary of South Staples Street, from which point the Northeast corner of Lot 8, Section 4 bears North 29° East 310.40 feet and thence South 61°00'30" East, 50.00 feet; THENCE South 29°00'00" West, with the West boundary of South Staples . Street, 453.48 feet for the South corner of this tract; • THENCE North 61°00'30" West, 1,268.00 feet to the East boundary of Ridgewood Unit 1, for the West corner of this tract; THENCE North 28°59'30" East, with said East boundary, 743.88 feet to the South boundary of said Naval Air Station Railroad right-of-way for the North corner of this tract; THENCE South 61°00'30" East with the South boundary of said Naval Air Station Railroad right-of-way 668.11 feet for the northerly East corner of this tract; THENCE South 28°59'30" West, a distance of 290.40 feet to a point, the. inner corner of this tract; THENCE South 61°00'30" East, 600.00 feet to the POINT OF BEGINNING. TRACT B Description for a 4.0 acre tract of land out of Lot 8, Section 4, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas and further. described by metes and bounds as follows: BEGINNING at the intersection of the Vest boundary of South Staples Street with the South boundary of the 40 foot wide Naval Air Station Railroad right- of-way for the Northeast corner of this tract, from which corner the Northeast corner of Lot 8, Section 4 bears North 29° East, 20.0 feet and thence South 61°00'30" East, 50.0 feet; THENCE South 29°00'00" West, with the West Boundary of South Staples Street, 290.4 feet for the South corner of this tract; THENCE North 61°00'30" West, 600.00' feet for the West corner of this tract; THENCE North 28°59'30" East, 290.4 feet to the South boundary of said Naval Air Station Railroad right-of-way for the North corner of this tract; THENCE South 61°00'30" East, 600.00 feet to the POINT OF BEGINNING. n SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as -amended from time to time, except as herein changed, shall remain in full force and •effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately. making aforesaid change for the purpose of maintaining at all times a.comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after rits passage, IT IS ACCORDINGLY SO ORDAINED, this the CJ day of 19 2/ .
