AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS
NECESSARY FOR THE ACQUISITION OF PARCELS 2 AND 2A
FOR THE CABANISS ACRES DRAINAGE IMPROVEMENTS PROJECT;
APPROPRIATING OUT OF THE NO. 220 STREET BOND FUND
FOR PROJECT NO. 220-77-2.13, CABANISS ACRES DRAINAGE
IMPROVEMENTS PROJECT, THE SUM OF $3,390, OF WHICH
$1,778 IS FOR ACQUISITION AND $1,612 IS FOR APPRAISAL
SERVICES AND INCIDENTAL COSTS RELATED TO CLOSING; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute documents necessary for the acquisition of Parcels 2 and 2A for
the Cabaniss Acres Drainage Improvements Project, Parcel 2 being acquired
from Samuel W. Dunnam, Jr., et al, and Parcel 2A being acquired from E. H.
Frederick, said parcels being more particularly described as follows:
PARCEL 2
Being a rectangularly shaped tract of land out of_Lot
2, Section 6, Bohemian Colony Lands as shown by map
of record in Volume A, Page 48, Map Records, Nueces
County, Texas, and being more particularly described_
as follows:
Beginning at a point being N. 61' 30' W., 40.0 feet -
and S. 29' W., 48.0 feet from the east corner of
abovementioned Lot 2;
Thence S. 29' 00' W., a distance of 25.0 feet to a
point;
Thence N. 61' 30' W., along a line that is 73.0 feet
southwest of and parallel to the northeast boundary
of Lot 2, a distance of 371.19 feet to a point;
Thence N. 29' 00' E., a distance of 23.0 feet to a
point;

Thence N. 61' 30' W., a distance of 78.81 feet to a
point;
Thence N. 29' E., 2.0 feet to a point;
Thence S. 61' 30' E., along a line that is 48.0 feet
southwest of and parallel to the northeast line of
Lot 2, a distance of 450.0 feet to the point of be -
beginning and containing 0.22 acres, more or less.

PARCEL 2A
Being a rectangularly shaped tract of land out of
Lot 2, Section 6, Bohemian Colony Lands as shown by
map of record in Volume A, Page 48, Map Records,
Nueces County, Texas, and more particularly des-
cribed by metes and bounds as follows:
Beginning at a point being N. 61° 30' W., 411.19
feet, and S. 29° 00' W., 50.0 feet, from the east
corner of abovementioned,Lot 2;
Thence S. 29° 00' W., 23.00 feet to a point;
Thence N. 61° 30' W., along a line that is 71.0 feet
southwest of and parallel to the northeast line of
Lot 2, a distance of 78.81 feet to a point;
Thence N. 29° 00' E., 23.0 feet to a point;
Thence S. 61° 30' E., along a line 46.0 feet south-
west of and parallel to the northeast line of Lot
2, a distance of 78.81 feet to the point of be-
ginning and containing 0.040 acres, more or less.
SECTION 2. That there -is hereby appropriated out of the No. 220
Street Bond Fund for the aforesaid project, No. 220-77-2.13, the sum of
$3,390, of which $1,778 is for acquisition and $1,612 is for appraisal
services and incidental costs related to closing.
SECTION 3. The necessity to authorize acquisition of the aforesaid
parcels and appropriation of the sums necessary to acquire said tracts or
parcels creates a public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date
of its introduction but that such ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor or Council
members, having requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the J3 day of May, 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, but that such ordinance or resolution shall be read
at three meetings of the City Council; I/we, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
