HomeMy WebLinkAbout16312 ORD - 06/10/1981AN ORDINANCE AMENDING THE PLATTING ORDINANCE NO. 4168, AS AMENDED, SECTION V, SUBSECTION A-3, TO ALLOW THE DIRECTOR OF ENGINEERING AND PHYSICAL DEVELOPMENT DISCRETIONARY AUTHORITY TO APPROVE FINAL PLATS UPON BEING SATISFIED THAT SUBDIVISION IMPROVEMENTS HAVE BEEN 75 PERCENT COMPLETED AND OTHER CONDITIONS MET AS SET OUT HEREIN; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section V, Subsection A-3 of the Platting Ordi- nance of the City of Corpus Christi, No. 4168, as amended, be amended to hereafter read as follows: "3. That the Director of Engineering and Physical Development be given discretionary authority to approve plats of subdivisions prior to the completion of the improvements under the following conditions: (1) That the plans for water, sewer, streets, and drainage which are required as a condition of the plat approval have been previously approved and that construction of improvements has been contracted for and is underway, and in the Director's opinion is 75 percent complete. (2) That the Developer submit to the Director of Engineering and Physical Development a sworn affidavit requesting approval of the plat, agreeing to complete the improve- ments to the satisfaction of the Director of Engineering and Physical Development prior to occupancy of any build- ing within the subdivision, and agreeing that any temporary utility service provided prior to completion of improvements may be terminated by the City with 24-hour notice if "sucFh improvements are not completed within ninety r(90)`da sy of • plat approval. (3) That the improvements remaining to be completed by the deve- loper shall not hinder or impede building construction within the subdivision. 86312 )k`l v;! , i LIIED SEP 271984 • r (4) Upon completion of all other subdivision requirements, park dedications, park deferment agreements, contracts of annexa- tion, maintenance agreements, or special covenants." SECTION 2. The necessity to amend the Platting Ordinance as hereinabove set forth at the earliest practicable date creates a public emergency and necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor or Council members, having declared that such emergency and necessity exists, having requested the sus- pension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and aftits passage, IT IS ACCORDINGLY SO ORDAINED, this the id day of , 1981.
