HomeMy WebLinkAbout16314 ORD - 06/10/1981AN ORDINANCE CLOSING AND ABANDONING A 10 -FOOT WIDE ALLEY IN A PORTION OF BLOCK 60, BLUFF,PORTION, AS RECORDED IN VOL. W,- PAGE 375, DEED RECORDS, NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con - ,kerning the closing of a 10 -foot wide alley in a portion of Block 60, Bluff Portion, as recorded in Vol. W, page 375, Deed Records, Nueces County, Texas, situated in the City of Corpus Christi, Nueces County, was given by publi- cation and mailed to the last known addresses of the owners of property abutting the public way proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on June 3, 1981, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portion of right-of-way, proposed to be closed, is not needed now, nor will it be within the foreseeable future needed as public right-of-way, and that the same should revert to the abutting property owners: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 10 -foot wide alley in a portion of Block 60, Bluff Portion, as recorded in Vol. W, page 375, Deed Records, Nueces County, Texas, and further described by metes and bounds as follows: Beginning at a point being the north corner jof Lot 3, Block 60, Bluff Portion as shown by plat recorded in Volume A, Page 2, 3, map records, Nueces County, Texas; Thence N. 0° 00' 15" E. 10.0 feet to a point for the north corner of this tract; Thence S. 89° 58' 56" E. 64.30 feet to a point being the south corner of Lot 11, Block 60 as shown by map of record in Volume W, Page 375, deed records, Nueces County, Texas; Thence S. 0° 00' 15" W. 10.00 feet to a point for the south corner of this tract; Thence N. 89° 58' W. 64.3 feet to the point of beginning and containing 0.015 acres more or less, be and the same is hereby closed for use as a public alley and shall revert to the abutting property owners. 16314. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its pur- pose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid portion of public right-of-way creates a public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor or Council member, having declared that such necessity exists, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the day of June, 1981.
