AMENDING THE CORPUS CHRISTI CITY CODE, 1976 .RCVISION,
AS AMENDED, BY AMENDING DIVISION 3. PRIVATE DRIVEWAYS
SECTION 49-42 SPECIFICATIONS, REVISING SUBSECTION (3),
PROVIDING FOR THE CONSTRUCTION OF CONCRETE DRIVEWAYS
CONNECTING TO ARTERIAL AND COLLECTOR STREETS THAT DO
NOT HAVE CONCRETE CURB AND GUTTER, BASED ON THE NEED
FOR THE STRUCTURAL STRENGTH TO SUPPORT THE ANTICIPATED
VEHICLE LOADS; PROVIDING FOR SEVERANCE; PROVIDING AN
EFFECTIVE DATE; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the Corpus Christi City Code, 1976 Revision, as
amended, be amended by amending Division 3. PRIVATE DRIVEWAYS, Section 49-42
Specifications, by revising the first paragraph of Subsection (3) to read as
follows:
"(3) Driveways connecting to streets that do not have concrete curb
and gutter shall not be constructed of concrete, but shall be constructed of
shell or caliche with or without asphaltic surface, provided, however, that
such driveways which provide access to properties zoned other than "R -1B,"
"R-2," "A-1," or "A-2" may be constructed of reinforced concrete on streets
that are classified arterial or collector, subject to ,approval of the Director
of Engineering and Physical Development. Such approval shall be based on the
need for the structural strength to support the anticipated vehicle loads.
The owner of property that the driveway is intended to serve shall furnish
the Director of Engineering and Physical Development an affidavit stating
that no credit of any type will be requested for said driveway against future
paving assessment programs by the City, that its construction will not impede
drainage of the ditches and that in the event ditch grade is required to be
changed to improve drainage, the property owner will be responsible for the
reconstruction of the driveway. Driveways connecting to streets that do have
concrete curb and gutter shall be constructed as follows:"
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word of provision of this ordinance shall be held invalid or

unconstitutional by final judgment of a court of competent jurisdiction it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
or provision hereof be given full force and effect for its purpose.
SECTION 3. This ordinance shall take effect from and after its
passage.
SECTION 4. The necessity to amend the provisions concerning the
specifications for private driveways as hereinabove more fully described
creates an imperative public necessity requiring the suspension of the
Charter rule that no ordinance or resolution shall be passed finally on the
date of its introduction but that such ordinance or'resolution-`shall be
read at three several meetings of the City Council, and the Mayor or Council
members, having declared that such necessity exists, having requested the
suspension of the Charter rule and that this ordinance be passed finally on
the date of its introduction and take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /7. .day

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, but that such ordinance or resolution shall be read
at three meetings of the City Council; I/we, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
