AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH
DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY AMENDING SECTION 31-5 BY ADD-
ING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5 94
SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIB D
TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS
CHRISTI, SAID TRACT BEING DESCRIBED AS A PORTION OF
FARRELL J. SMITH 225.2 ACRE TRACT OF LAND, OUT OF
THE MARIANO LOPEZ DE HERRERA GRANT, MORE FULLY DE-
SCRIBED HEREINAFTER IN NUECES COUNTY, TEXAS; REPEAL-
ING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING
FOR PUBLICATION; AND DECLARING AN EMERGENCY
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning certain amendment to the text of
the Zoning Ordinance of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons wish-
ing to appear and be heard were heard, to consider the same before the City
Council of the City of Corpus Christi, in accordance with proper notice to
the public, said public hearing having been held on January 14, 1981, at
Special Council Meeting of the City Council in the City Council Chambers of
the City Hall in the City of Corpus Christi; and the City Council further finds
as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "A-1" Apart-
ment House District should be granted to the tract of land consisting of
approximately 7.390 acres of land, being described as generally on the north
side of Teague Lane, approximately 375 feet west of Calallen Drive, in Nueces
County, Texas;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains
no reference to zoning;

(3) That the permanent zoning of "A-1" Apartment House District be
granted to the aforesaid described and hereinafter more fully described
parcel or tract of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
serve public health, necessity and convenience and the general welfare of
the City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9,
pages 565 et seq of the Ordinance and Resolution Records, as amended from
time to time, and particularly as amended by Ordinance No. 6106, passed and
approved by the City Council on the 29th day of March, 1961, be, and the same
is hereby, amended by making the change hereinafter set out.
SECTION 2. There is hereby amended Article 31 of the Zoning Ordin-
ance of the City of Corpus Christi, Section 31-5, by adding a new subsection,
31-5.31, said new subsection to hereafter read as follows, such zoning classi-
fication of the hereinafter described property to be effective upon annexa-
tion: a
"Section 31-5. 'The following described tract of land shall be
zoned and classified "A-1" Apartment House District:
Description of 7.390 acres more or less, out of Farrell J.
Smith 225.2 acre tract of land, out of the Mariano Lopez
de Herrera Grant, State Abstract No. 606, Nueces County,
Texas, and more fully described by metes and bounds as
follows:
Beginning at a point in the centerline of County Road 54A,
also known as Teague Lane, which bears S80°00'00"E 700.00
feet from the centerline intersection of the said County
Road 54A and County Road 67A, also known as Wildcate Drive,
for the Southeast corner of this tract;
Thence N80°00'00"W 370.00 feet to a point for the South-
west corner of this tract;
Thence N10°00'00"E 870.00 feet to a point in the South
boundary line of Cenizo Canyon, Unit 2, as shown by plat
recorded in Volume 40, Pages 96 and 97, Map Records of
Nueces County, Texas for the Northwest corner of this
tract;
Thence S80°00''00"E 370.00 feet to a point for the Northeast
corner of this tract, said point being the Northwest corner
of a Calallen Independent School District tract of land;
Thence S10°00'00"W 870.00 feet along the West boundary line
of said Calallen Independent School District tract of land
to the point of beginning.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making the aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates an imperative public neces-
sity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor, having declared that such emergency and necessity
exist, having requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORD-
INGLY SO ORDAINED, this the /7 day of June, 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, but that such ordinance or resolution shall be read
at three meetings of the City Council; I/we, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
