HomeMy WebLinkAbout16369 ORD - 07/08/1981;p;6/24/81;2d,; AN ORDINANCE FINDING THAT THE COST OF PROVIDING INTRA -CITY CHARTER BUS SERVICE HAS SUBSTANTIALLY INCREASE; ESTABLISHING NEW RATES FOR INTRA -CITY CHARTER BUS SERVICE; AMENDING SECTION 1 OF ORDINANCE 13524; PROVIDING FOR SEVERABIL- ITY; PROVIDING FOR PUBLICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, Ordinance No. 15891 passed and approved by the City Council on December 19, 1980 established rates for intra -city charter bus service; and WHEREAS, the cost of providing intra -city charter bus service has increase substantially since the previous rates were established; and WHEREAS, the City Council had determined that an increase in intra- city charter bus service rates is essential; and WHEREAS, the City Council finds that the hereinafter prescribed rates are reasonable, just and fair, being in the public interest: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 15891, passed and approved by the City Council on December 19, 1980 is hereby amended by amending Section 2 (B) of the rate schedule for intra -city charter bus service provided by the City - owned buses, to hereafter provide as follows: "(B) Intra -City Charter Rates (1) 45 -passenger air conditioned buses, 2 hour minimum fifty dollars ($50); for each additional 15 minutes past 2 hours (or fraction thereof) an additional five dollars ($5.00) shall be charged. (2) 35 -passenger air conditioned buses, 2 -hour minimum forty dollars ($40); for each additional fifteen (15) minutes past 2 hours (or fraction thereof) an additional five dollars ($5) shall be charged. (3) Intra -City charter rates may be negotiated for any large volume movements by the Transit General Manager subject to the approval of the Director of Traffic and Transit. Large volume movements 'or -activities including but not limited to school athletic programs and music festivals. Negotiated rates limited to movements involving over one hundred (100) hours per week. The Transit General Manager shall, in addition to consider- ation of rates and fares charged for single riders and the hours of movement per week, be guided in formulating a negotiated trip rate by the following factors: 1. Number of persons to be transported; 2. One-way or round-trip feature of trip; 3. Total mileage to be run; 4. Number of trips committed to be made by the group on the City Transit System; M1CROEILMER 16369 5. Type of bus to be used; 6. Hours of the day and the day or days of the week of trip duration; 7. Age and physical condition of the passengers; 8. Quantity, dimensions, weight, and shape of accompanied and unaccompanied baggage, if any, to be transported, and 9. Number of stops to be made between origin and destination and duration of stops. SECTION 2. If for any reason, any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. All ordinances or parts of ordinances in conflict here- with be and the same are hereby repealed to the extent of such conflict. SECTION 4. This ordinance shall be effective from and after August 1, 1981. SECTION 5.
