HomeMy WebLinkAbout16375 ORD - 07/08/1981•Al•ikh:7_1-81;2nd: AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF 0. DEAN COUCH, JR. BY GRANTING A PLANNED UNIT DEVELOPMENT - 2 FOR A RrSIDENTIAL DEVELOPMENT ON 21.8T8 ACRES OUT OF LOT 2, W. E. POPE ESTATES, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS MORE PARTICULARLY DESCRIBED ON THE APPROVED PLANS SIGNED BY THE CHAIRMAN OF THE PLANNING COMMISSION AND CERTIFIED BY THE CITY SECRETARY AS APPROVED BY THE CITY COUNCIL; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of 0. Dean Couch, Jr. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, July 1, 1981 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would - best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of- August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 16375 MICROFILMED ?SEP 2 71984 SECTION 2. That the application for Planned Unit Development - 2 for a residential development on 21.818 acres out of Lot 2, W. E. Pope Estates, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby approved, said development being more particularly described on the approved plans signed by the Chairman of the Planning Commission and certified by the City Secretary as approved by the City Council, the said tract or parcel being more particularly described as follows: Being 21.818 acres designated as Lot 2 out of a 32.895 acre tract, said 32.895 acre tract being 29.665 acres out of the W. E. Pope Estate lands of which - -a portion of said estate, known and recorded by plat as Brooklyn, Volume A, Page 30, Nueces County Map Records cancelled October 24, 1930 by deed recorded in Volume 194, Page 543, Deed Records of Nueces County, and being 3.23 acres out of_ submerged lands, known as Tract No. 1. conveyed by Patent 446 to the Nueces County -Navigation District No. 1 by the State or Texas,by deed recorded in -Volume 719, Pages 358-360, Deed-Recoras of Nuece`s County, (exas, and said Lot 2 being more particularly described in metes and bounds as follows: BEGINNING at a point in the east Nueces County Navigation District bulkhead line to Canal A of the Rincon Industrial Park and at the centerline of Canal Number 1 for the southwest corner of said Lot 2, whence a 1" iron pipe at the southwest corner of said 32.895 acre tract bears South 32° 08' 00" West, a distance of 389.06 feet; THENCE'North 32° 08' 00" East along said east Nueces County Navication District bulkhead tine, a distance of 1599.61 feet to a point for the northwest -corner of said Lot 2; THENCE South 57° 52' 00" East along the north boundary of said Lot 2, a distance of -48.70 feet to a point for a corner; THENCE South 46° 48' 52" East along the north boundary of said Lot 2, a distance of 658.76 feet to a point in the west right-of-way line of U. S. Hichway 181 for' the northeast corner of said Lot 2; --THENCE South 430 01' 08" West along said west right-of-way line and along the east boundary of the said 32.895 acre tract, a distance of 794.30 feet to a point for a corner; THENCE South 32° 08' 00" West along said west right-of-way line and along the east boundary'of the said 32.895 acre tract, a distance of 877.73 feet to a' point for the southeast corner of said Lot 2; THENCE -North 46° 58' 52" West along the centerline of Canal Number 1, a distance - of 570.26 feet to the point of beginning and containing 21.818 acres of land, -more or less.. SECTION 3. That the Zoning Ordinance and Map of the City of Corpus Christi, -Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. - -- - SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. • SECTION 5. That the necessity forimmediately making the aforesaid change for the purpose of maintaining at all times a comprehensive zonino ordinance for the City of Corpus Christi creates an imperative public neces— sity requiring the.suspension of the Charter rule that no ordinance or resolu— tion shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three_several-meetings of thCity Council, and the Mayor or Council members, having declared that such public necessity exists, having requested the suspension of theCharterrule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and er its passage, IT IS ACCORDINGLY SO ORDAINED this the p day of 1981: ATTEST: y Secretary APPROVED: I DAY OF , 19 / : J.
