AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
CANDY STICK CORPORATION BY AMENDING THE ZONING MAP
BY CHANGING THE ZONING ON TRACT A AND TRACT B OUT
OF SHARE 3 and 4, JOHN HARNEY PARTITION, SITUATED
IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
FROM "F -R" FARM -RURAL DISTRICT TO "R-16" ONE -FAMILY
DWELLING DISTRICT ON TRACT A AND "R-2" MULTIPLE
DWELLING ON TRACT B; KEEPING IN EFFECT ALL OTHER PRO-
VISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEAL-
ING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLAR-
ING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of
Candy Stick Corporation for amendment to the zoning map of
the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday,
July 1. 1981 , at Special Council Meeting of the
City Council in the Council Chamber at City Hall in the City of Corpus Christi;
and
WHEREAS, by motion duly made, seconded and carried, it was decided -
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, passed on the 27th day of -August, 1937, appearing of record
in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as
amended from time to time, and in particular as amended by Ordinance No. 6106,
as amended, be and the same is hereby amended by making the change hereinafter
set out.

SECTION 2. That the zoning of Tracts A and B, out of Share 3 and
4, John Harney Partition, situated in the City of Corpus Christi, Nueces
County, Texas, be and the same is hereby changed from "F -R" Farm -Rural District
to "R -1B" One Family Dwelling District on Tract A and from "F -P." Farm -Rural
District to "R-2" Multiple Dwelling District on Tract B, said tracts being
more fully described as follows:
TRACT A
Being a 102.05 acre tract or parcel of land being all
of Share 3 and Share 4 of the John Harney Partition, a
map of which is recorded in Vol. 6, page 29, Map Records
of Nueces County, Texas:
BEGINNING at an axle found on the Southwest subdivision line of Nolford
Place, a map of which is recorded in Volume 42, Pages 128, 129 of said Map
Records for the North corner of Share 2 and the East corner of said Share 3
for the East corner of this survey;
THENCE South 37°29'00" West, along the common boundary line of Share 2
and 3, 4,214.25 feet to an axle found for the West -corner of Share 2 and the
South corner of Share 3 for the South corner of this survey;
THENCE North 53°08.45" West, along the Southwest boundary line of said
Shares 3 and 4, 1,050.57 feet to a 5/8 inch iron rod set for the West corner of
Share 4 and the West corner of this survey;
THENCE North 37° 30'10" East, along the Northwest boundary line of Share
4, 4,254.92 feet to a 2 inch iron pipe found for the North corner of Share 4
and the North corner of this survey;
THENCE South 50°55'30" East, along -the Northeast boundary line of said
Shares 4 and 3, 1,049.47 feet to the POINT OF BEGINNING,containing 102.05
acres of land, save and except 2.16 acres of land within said 102.05 acre
tract to be zoned R-2. ----
TRACT B
Being a 2.16 acre tract or parcel of land out of Shares
3 and 4, John Harney Partition, a map of which is recorded
in Vol.6, page 29, Map Records of Nueces County, Texas:
BEGINNING at the upper East corner of this tract from which corner a 2
inch pipe found to mark the North corner of said Share 4 bears North 52°29`50°
West 290.00 feet and North 37°30'10" East 1,101.85 feet, more or less;
THENCE South 37°30'10" West 184.42 feet for an inside corner of this tract;
THENCE South 22°04'40" East 480.42 feet for the Iower East corner of this
tract;
THENCE South 02°20'57" West 120.00 feet for the South corner of this tract
and the point_of curvature of a circular curve to the left whose radius point
bears South 02°20'57" West 480.00 feet and has a central angle of 08°03'17", a
radius of 480.00 feet, a tangent distance of 33.80 feet and an arc Iength of
67.48 feet;
THENCE with said curve to the left, 67.48 feet for the point of tangency
of another circular curve to the right whose radius point bears North 05°42420"
West 10.00 feet and has a central angle of 73°37'40", a radius of 10.00 feet, a
tangent distance of 7.49 feet and an arc length of 12.85 feet;
THENCE with said curve to the right, 12.85 feet for the point of tangency;
THENCE North 22°04'40" West, parallel with the City of Corpus Christi's
25.00 foot wide water line (36 inch water main) easement thereof and 60,00 feet
distant from its East easement line, measured at right angles thereto, 482.16 feet
for the point of curvature of a circular curve to the right which has a central
angle of 59°34'50", a radius of 250,00 feet, a tangent distance of 143.I2 feet
and an arc length of 259.97 feet;
THENCE with said curve to the right, 259.97 feet for the point of tangency;
THENCE North 37°30'10" East, parallel with the Northwest line of said
Share 4 and 170.00 feet distant therefrom, 100.00 feet for the point of curva-
ture of a circular curve to the right which has a central angle of 90°00'00",
a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of
15.71 feet;
THENCE with said curve to the right, 15.71 feet for the point of tangency;
THENCE South 52°29'50" East, 110.00 feet to the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended
from time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making aforesaid
-change for thepurposeof maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that
no -ordinance or resolution shall be passed finally on the date of its introduc-
tion and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared that such emergency
and necessity exist, having requested the suspension of the Charter rule
and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and a r its passage,
IT IS ACCORDINGLY SO ORDAINED, this the day of

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, but that such ordinance or resolution shall be read
at three meetings of the City Council; I/we, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
