AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH
DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY AMENDING SECTION 31-5 BY
ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.31,
SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED
TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS
CHRISTI, SAID AREA BEING DESCRIBED AS A TRACT OF
PARCEL CONTAINING 45.17 ACRES, MORE OR LESS, OUT OF THE
MARIANO LOPEZ DE HERRERA GRANT, ABSTRACT NO. 606, AND
DESCRIBED IN DEED OF RECORD IN VOL. 272, PAGE 166,
DEED RECORDS OF NUECES COUNTY, TEXAS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICA-
TION; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning certain amendments to the text of
the Zoning Ordinance of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons wish-
ing -to appear and be heard were heard, to consider the same before the City
Council of the City of Corpus Christi, in accordance with proper notice to
the public, said public hearing having been held on July 8, 1981, at Regular
Council Meeting of the City Council in the City Council Chambers of the City
Hall in the City of Corpus Christi; and the City Council further finds as
follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "B-4" General
Business District on the parcel or- tract of land, more fully described herein-
after, containing 45.17 acres, more or less, out of the Mariano Lopez de Herrera
Grant, Abstract No. 606, being a portion of land described in deed of record
in Vol. 272, page 166,'Deed Records of Nueces County, Texas, situated in Nueces
County Texas.
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning; ���

(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels or
tracts of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9,
pages 575 et seq of the Ordinance and Resolution Records, as amended from
time to time, and particularly as amended by Ordinance No. 6106, passed and
approved by the City Council on the 29th day of March, 1961, be and the same
is hereby, amended by making the change hereinafter set out.
SECTION 2. There is hereby amended Article 31 of the Zoning Ordi-
nance of the City of Corpus Christi, Section 31-5, by adding a new subsection,
31-5.31, said new subsection to hereafter read as follows, such zoning classi-
fication of the hereinafter described property to be effective upon annexation:
"Section 31-5.31 The following described tract of land shall be
zoned and classified as "B -4" -General Business District:
Being a tract of land situated in Nueces County, Texas, North of F. M. Road No.
624 and East of State Highway No. 77, containing 45.17 acres, more or less, out
of the Mariano Lopez de Herrera Grant, Abstract No. 606, and being a portion of
the same land described in deed of record in Volume 272, Page 166 of the Deed
Records of Nueces County, Texas, and being more particularly described by metes
and bounds as follows, to -wit: -
-Beginning at a 1 inch iron bar at the intersection of the westerly boundary line,
of the right-of-way of Calallen Drive with;.the southerly boundary line of the
right-of-way of Wildcat Drive, for the NE corner of this tract and the point of
beginning;
THENCE S 07'-30'-18" W, along the westerly boundary line of the right-of-way of
said Calallen Drive, a distance of 216.87 feet to a point marked by a 5/8 inch •
iron rod set in the westerly boundary line of the right-of-way of said State
Highway No. 77, for an easterly corner of this tract;
-THENCE, in a southwesterly direction, along a curve to the right whose central
.angle is 21'-25'-15" and whose radius is 2084.08 feet, and along the westerly
boundary line of the right-of-way of said State. Highway No. 77, a distance of
779.16 feet to a point marked by a-5/8 inch iron rod, for an easterly corner of
-this tract; -

THENCE S 09°-30'-03" W, -along the westerly boundary line of the right-of-way of _ -
said State Highway No. 77, a distance of 401.42 feet -to a point marked by a 5/8 -
inch iron rod set at the instersection of the northerly boundary line of the
-right-of-way of said F. M. Road No. 624, for a southerly corner of this tract;
--THENCE S 51°-48'-S5" W, along the northerly boundary line of the right-of-way of
said F. M. Road No. 624, a distance of 145.73 feet to a point marked by a 5/8 inch
iron rod -for a southerly corner -of this tract;
THENCE N 84°-57'-40" W, along the northerly boundary line of the right-of-way of
-said F. M. Road No. 624, a distance of 1053.93 feet (measured 1053.93 feet, deed
call 1051.06 feet) to a point marked by a 5/8 inch iron rod for a southwesterly
corner of this tract;
THENCE N 37°-53'-03" W, along the northerly boundary line of said F. M. Road No.
-624, a distance of 136.21 feet to a point masked by a 5/8 inch iron rod set in '
.easterly_boundary lin e.of said Wildcat Drive, for a southwesterly -corner of this .

THENCE N 09°-11'-31" 8, -along the easterly boundary line of said Wildcat Drive.
a distance of 1473.6 -feet to a point marked by a 1 inch iron bar, for the

'THENCE S 80°-39'-05" E, along the'southerly boundary line -of said Wildcat Drive, .
=a distance of 1391.04 feet to the point of beginning, and containing 45.17 acres
of-iand., -more or less.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
-time to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making the aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordinance
or resolution shall be read at three several meetings of the City Council, and
the MayororCouncil members, having declared that such necessity exists,
having requested the suspension of the Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, but that such ordinance or resolution shall be read
at three meetings of the City Council; I/we, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
