HomeMy WebLinkAbout16385 ORD - 07/15/1981jkh:7=15=81;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE CONTRACT WITH CHARLIE BELLAH FOR ARCHITECTURAL SERV- ICES RELATED TO DESIGN OF IMPROVEMENTS TO THE WOODLAWN RECREATION CENTER (ALSO KNOWN AS OAK PARK), WHICH REVISES THE SCOPE OF WORK AND INCREASES THE FEES, ALL AS MORE FULLY SET FORTH IN THE AMENDMENT TO THE CONTRACT, A SUB- STANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; APPROPRIATING $2,166.58 OUT OF THE NO. 291 PARK BOND FUND FOR ADDITIONAL FEES APPLICABLE TO PROJECT NO. 291-72-10, WOODLAWN RECREATION CENTER; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an amendment to the contract with Charlie- Bellah for architectural services related todesign of improvements to the Woodlawn Recreation Center (also known as Oak Park), which revises the scope of work and increases the fees, all as more fully set forth in the Amendment to the Contract, a sub- stantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. There is hereby appropriated out of the No. 291 Park Bond Fund for additional fees applicable to Project No. 291-72-10, Woodlawn Recreation Center, the sum of $2,166.58 for the aforesaid services. SECTION 3. The necessity to authorize execution lof the amendment to the contract and to appropriate the necessary sums to effectuate the said amendment creates a public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor or Council members, having declared that such necessity exists, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the IS day of July, 1981. BRUCE COC , C/S�CIY ATTORNEY By istant City Att ney THE CITY OF CORPUS CHRISTI, TEXAS ;( i IL, 16385 SEP 2 71984 AMENDMENT NO. 1 TO THE CONTRACT FOR ARCHITECTURAL SERVICES THE STATE OF TEXAS COUNTY OF NUECES �( The City of Corpus Christi, hereinafter called "City", and Charlie Bellah, hereinafter called "Architect", agree to the following amendment to the contract for architectural services approved by Ordinance No. 11398, execu- ted on March 28, 1973 and further amended on June 16, 1976 by the passage of Ordinance No. 13231. 1. Services to be Performed Architect and City agree that the concept of services to be performed is changed from that originally contemplated in the agreement dated June 16, 1976 to include plans and specifications for remodeling and enlarging the recreation center, and that the construction of the pool is deleted from the architectural contract. It is further noted that the architectural services pertaining to the swimming pool have been satisfied through the construction documents phase. In addition, it is further understood that the intent of the original contract has been met by the Architect. 2. Fees for Architectural Services The Architect and City agree that the final fee for services is to be calculated on the basis of eight and seventy-five one - hundredths percent (8.75%) times actual construction cost for new construction, and eleven and sixty-four one -hundredths percent (11.64%) times the actual construction cost for remodeling as follows: Recreation Building Remodeling of Existing Building at (11.64%) ($68,000) _ $ 7,915.00 New Construction at (8.75%) ($41,443) = 3,626.00 Total $11,541.00 Less Credit to City for Reuse of Plans (-974.42) TOTAL ADJUSTED FEE $10,566.58 EXECUTED IN DUPLICATE, each of which shall be considered an original this _ day of , 1981.
