AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 575, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
VILLAGE PARK SQUARE BY GRANTING A SPECIAL COUNCIL PERMIT
FOR "B-1" NEIGHBORHOOD BUSINESS DISTRICT USES ON A PART
OF LOT 2, BLOCK 1, STONEGATE UNIT 1, SITUATED IN THE
CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS MORE
PARTICULARLY DESCRIBED ON THE SITE PLAN, A COPY OF
WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A", AND SUBJECT TO THE CONDITIONS
SET FORTH HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVI-
SIONS OF THE EXISTING ORDINANCE AS AMENDED• REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of
Village Park Square for amendment to the zoning map of the City of
Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wish-
ing to appear and be heard were heard, to consider the same before the City
Council of the City of Corpus Christi, in accordance with proper notice to
the public, said public hearing having been held on Wednesday , June 10,1981,
at Special Council Meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9,
Pages 575, et seq, of the Ordinance and Resolution Records, as amended from
time to time, and in particular as amended by Ordinance No. 6106, as amended,
be and the same is hereby amended by making the change hereinafter set out.

SECTION 2. That a Special Council Permit be granted for "B-1"
Neighborhood Business District uses on a 0.55 acre tract of land out of
Lot 2, Block 1, Stonegate North Unit 1, a map of which is recorded in
Vol. 40, pages 46-47, Map Records of Nueces County, Texas, and as more fully
described on the site plan, a copy of which is attached hereto and made a
part hereof, marked Exhibit "A", subject to the added restriction that there
be no access to the alley. Said portion of Lot 2 is more fully described as
follows:
BEGINNING at the point of tangency of a circular curve
on the Northeast right-of-way line of Bonner Drive, from
which point the radius point of said curve bears North 29°
04' 10"East, 10.00 feet and from whence the centerline in-
tersection of Bonner Drive and Everhart Road bears South 29°
04' 10" West '30.00 feet and South 60° 55' 50" East 50.00
feet;
THENCE North 60° 55' 50" West with said_Northeast right-
of-way line of Bonner Drive, 220.00 feet to the point of cur-
vature of a circular curve to the right which has a central
angle of 90° 00' 00" a radius of 10.00 feet, a tangent dis-
tance of 10.00 feet for an arc length of 15.71 feet;
THENCE with said curve to the right 15.71 feet to the
point of tangency, said point being on the Southeast boundary
line of a 20 foot wide alley and the Northwest boundary line
of said Lot 2;
THENCE North 29° 04' 10" East with said Southeast boun-
dary line of a 20 foot alley, 90.00 feet for the- North cor-
ner of this tract;
THENCE South 60° 55' 50" East 239.95 feet to a point on
the Northwest right-of-way line of Everhart Road for the -East_
corner of this tract;
THENCE South 29° 02' 10" West with said Northwest right-
of-way line of Everhart Road to, 90.00 feet to the point of
curvature of a circular curve to the right which has' a cen-
tral angle of 90° 02' 00" a radius of 10.00 feet, a tangent
distance of 10.01 feet,for:an-arc length of 15.72 feet;
THENCE with said curve to the right 15.72 feet to the
POINT OF BEGINNING.
In the event the Board of Adjustment grants any special exception
or variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.

SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended
from time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts'of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor or Council members, having,
declared such emergency exists, having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from . after its passage,
ITS IS ACCORDINGLY SO ORDAINED, this the /nay of . ! , 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, but that such ordinance or resolution shall be read
at three meetings of the City Council; I/we, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
