HomeMy WebLinkAbout16416 ORD - 07/22/1981AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, CT SEq, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF FRANK J. SITTERLE BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A PORTION OF LOT 1, TRACT B AND LOT 8, SECTION 5, RANGE VIII, GUGENHEIM AND COHN's FARM LOTS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "T-7" 1 TGHT INDUSTRIA! DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Frank J. Sitterle for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, July 22, 1981 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the zoning on a portion of Lot 1, Tract B, and portion of Lot 8, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from R -1B" One -Family Dwelling District to "I-2" Light Industrial District: TRACT A Description of a 1 .190 acres tract of land out of Lot 1, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots (Vol . A, p. 53, Map Records, Nueces County, Texas) . Beginning at a 5/8" iron rod in the west line of Lot 1, Section 5, Range VIII, said point being N 540 12' 32" E, 378.70' and North 1634.48' from a 1" iron pipe at the intersection of the northwesterly line of Old Brownsville Road with the nc.theasterly line of South Padre Island Drive: THENCE: North 300.00' to a point; THENCE: East 345.59' to a point; THENCE: S 48° 50' 59" W, 458.96' to the point of beginning, said tract containing 1 .190 acres of land . TRACT B Description of d 1 .264 acre tract of land out of Lot 8, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots (Vol . A, p . 53, Map Records, Nueces County, Texas) . Beginning at a 1 "iron pipe in the northwesterly line of Old Brownsville Road, a 120' wide road, said point being N 54° 12' 32" E, 378.70 feet from a 1" iron pipe at the intersection of the northwesterly line of Old Brownsville Road with the northeasterly line of South Padre Island Drive: THENCE: North 400.00' to a point; THENCE: S 53° 48' 29" E, 341 .19' to a concrete monument in the northwesterly line of Old Brownsville Road; THENCE: With said northwesterly line 5 54° 12' 32" W, 339.46' to the point of beginning, said tract containing 1 .264 acres of land. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Clap of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. 2 SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity for immediately making the aforesaid change for the purpose of maintaining at all times a comprehensive zonino 'ordinance for the City of Corpus Christi creates an imperative public neces- sity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor or Council members, having declared that such public necessity exists, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and er its passage, IT , 1981.
