AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, AS AMENDED, BY AMENDING CHAPTER 36, PARKS RECREATION, CULTURAL AND LEI- SURE TIME ACTIVITIES, ARTICLE F. IN GENERAL, BY ADDING THERETO PROVISIONS FOR PROHIBITING OVER- NIGHT CAMPING AND THE BUILDING OF CAMPFIRES ON CORPUS CHRISTI BEACH; PROVIDING FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: .° SECTION . That the Code of Ordinances, City of Corpus Christi, 1976 Revision, as amended, be and the same is hereby amended by amending Chapter 36,'Parks; Recreation; Cultural and Leisure Time Activities, Article I, In General, by adding thereto the following provision, to be designated Section 36-9, Regulation of Overnight Camping and Campfires: "Section 36-9. Regulation of Overnight Camping and Campfires. A. Definitions. Camping. Occupying a site as a dwelling place for any length of time, whether the person be in a vehicle, tent,- an improvished shelter, sleep- ing bag, or without shelter. Occupation of a site for more than two hours -_ after midnight shall be conclusively presumed to be overnight camping. Campfires. Any open fire of any material in a fire pit or on the, sand, except for those fires contained in a portable barbeque pit or similar device and used only for preparation of food. Corpus Christi Beach + 1.6 miles (1.4 miles of original beach development plus + .2 miles of additional beach caused by shifting sand) of river sand beach bounded on the South by Rincon Breakwater,on the West by the Westside of North Shoreline Blvd, on the East by Corpus Christi Bay and on the North by water entry to Nueces Bay, as depicted on the map, attached hereto and marked Exhibit "A". Person. Any person, group of persons, firm, partnership, associa- tion, corporation, company or organization of any kind. B. Prohibition. It shall be unlawful for any person to camp on Corpus Christi Beach overnight or to build campfires on Corpus Christi Beach. The City shall have the right to remove from Corpus Christi Beach any person who is camping or building fires on Corpus Christi Beach in violation of this ordinance. 1_6117 OFILMED,. SEP 2 71984 C. Exceptions: 1) Corpus Christi Beach Park: A person may camp overnight at Corpus Christi Beach Park for a period not to exceed two nights, and only within those areas designated as campgrounds by signs within the park. Park boundaries are identified in Exhibit 'A' attached hereto." SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SP p) 7 2f l,/1n c -op r MOTION TO AMEND T U(-JVEfe- moved and DU/%P/-17 seconded this motion to amend the Ordinance prohibiting overnight camping and the building of campfires on the sands at Corpus Christi Beach, passed on the first reading by the City Council of the City of Corpus Christi on July 15, 1981, and on the second reading on July 22, 1981, as follows: 1. -Amending Paragraph B of Section 36-9 of. Section 1 of the Ordinance to read as -follows: - "Prohibition: It shall be unlawful --for any person to camp on Corpus Christi Beach overnight, or to build --or-use a campfire on Corpus Christi Beach at any time. The City shall have the right to issue a citation to and/or remove from Corpus Christi Beach any person who_ is camping, or building or using campfires on Corpus -Christi Beach in violation of this Ordinance."
