HomeMy WebLinkAbout16423 ORD - 07/29/1981jd/mb 6/29/81; 1st it - AN ORDINANCE FINDING THAT THE 1908 WHARF CORPORATION HAS FAILED TO COMPLY WITH ARTICLE XIV OF THE AGREEMENT(TO CONTRACT AUTHORIZED BY ORDINANCE 14809 PASSED AND"APPROVED BY THE CITY COUNCIL ON MARCH 7, 1979; DECLARING A FORFEI- TURE OF THE 1908 WHARF CORPORATION'S BID SECURITY OF $1,000 TO THE CITY AS LIQUIDATED DAMAGES PURSUANT TO ARTICLE XIV OF SAID AGREEMENT TO CONTRACT; AND REPEAL- ING ORDINANCE NO. 14809; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 1908 Wharf Corporation is in violation of Article XIV of the Agreement to Contract authorized by Ordinance No. 14809 passed and approved by'the City Council on March 7, 1979, and that the 1908 Wharf Corporation has failed to execute the lease agreement for the opera- tion of a barge restaurant on the east side of the Cooper's Alley L -Head and that said barge restaurant was not ready to open for business and was not fully capable of operation by December 31, 1980. SECTION 2. That the 1908 Wharf Corporation's bid security of $1,000 should be and is hereby forfeited to the City of Corpus Christi, Texas as liquidated damages for the violation set forth in Section 1 hereof. SECTION 3. That Ordinance 14809 passed and approved by the City Council on March 7, 1979, is hereby repealed. SECTION 4. The necessity to repeal Ordinance No. 14809 and to declare a forfeiture of the 1908 Wharf Corporation's bid security as liqui- dated damages creates an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor or Council members, having declared that such necessity exists, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .25 day ofJ j 1981.
