HomeMy WebLinkAbout16426 ORD - 07/29/1981• AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF GEORGE S. HAWN INTERESTS AND JOHN D. HAWN BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PART OF LOT 1, SECTION 12, BOHEMIAN COLONY LANDS, CONSISTING OF APPROXIMATELY 57.39 ACRES • SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "B-3" BUSINESS DISTRICT AND "I-2" LIGHT INDUSTRIA, TO "R-4" GFNERAL BUSINESS DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of GFORGF S. HAWN INTERESTS AND JOHN D. HAWN for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on JULY 22, 1981 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of -August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the zoning of a portion of Lot 1, Section 12, Bohemian Colony Lands, consisting of approximately 57.39 acres, situated in the City of Corpus Christi, Nueces County, Texas, beandthe same is hereby changed from "B-3" Business District and "I-2" Light Industrial District to "B-4" General Business District: Beginning at the point of intersection of the Northwest boundary line of Lot 1, Section 12, Bohemian Colony Lands and the'Southwest right-of-way line of Saratoga Boulevard for a corner that is the East corner of U.S. Government Property of Cabaniss Field Naval Auxiliary Landing Field and the North corner of this tract from which corner the North corner of -said Lot 1 -bears North 29° 00' 00" East 60 feet; - Thence South 610_30' 45" East_a distance of_2411.9 feet more or. less .- along the Southwest right-of-way line of Saratoga Boulevard (Texas -Highway 357), parallel to the center line thereof and -60 feet distance therefrom, to a point for the upper East corner of this tract; Thence with the flared right-of-way line -of Saratoga Boulevard South 34° 50' 47" East a distance of 202.29 feet more or less -to a point which is - at its intersection with the Northwest right -of -may line of -Weber -Road (Texas -_ Highway FM 43) for the lower East corner of this tract; - - - Thence South 29° 00' 00" West along- the Northwest right -of -way -line of_ Weber f- Weber Road parallel to the center line thereof and 50 feet distance -therefrom,. - measured at right angles thereto; a distance -of 1169.25. feet more or less - to a point on the common boundary line at the Southwest side of said Lot 1, and Northeast side of Lot 2, -Section 12, -Bohemian -Colony Lands -for the South corner of this tract; _ ___ - - - - -_ - - - Thence North 61° 30' 45" West along the aforementioned common lbt boundary line at the Southwest side of this tract a distance of 911.9 feet more or less to a point for a corner to the rights -and at the beginning of -a --- circular curve to the left in a -Northeasterly direction; - Thence leaving the Southwest boundary-of_said-Lot_1, Section 12, Bohemian Colony Lands at the corner with a circular curve to the left whose -radius point-_ bears North 34° 19' 26" West 5500 feet, having a central_angle of 05°-32_-40",,.. a radius of 5500 feet, a tangent distance of 266.32 feet, an arc length of_ - - 532.24 feet and an initial tangent bearing.North 50° 07' 54" East to a point- for.a corner within the eastern half of said Lot 1; - Thence North 39° 52' 06" West a distance of 1000 feet more or less to a point inside the Western half of said Lot 1, for a corner to the -left in a Southwesterly direction; Thence along a circular curve to the right whose radius- point bears North 39° 52' 06" West 4500 feet, having a central angle of 12° 15' 16", a radius - of 4500 feet, a tangent distance of 483.07 feet, an arc length of 962.45 feet and an initial tangent bearing South 62' 23' 13" West to a point on the common boundary line of the Southwest side of said Lot 1, Section 12 and the Northeast side of Lot 2, Section 12, Bohemian Colony Lands, for corner of this tract; Thence North 61° 30' 45" West a distance of 530 feet more or less along - the said common lot line of Lots 1 and 2, Section 12, Bohemian Colony Lands, to a point on the Southeast boundary line of said U.S. Government Property of Cabaniss Field Naval Auxiliary Landing Field for the West corner of this tract; Thence North 29° 00' 00" East a distance of 1260 feet more or less along the common line of the Northeast boundary line of U.S. Government Property of NALF Cabaniss Field and the Southwest side of Lot 1, Section 12, Bohemian Colony Lands to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day_of August, -1937, as amended from time to time, except as herein changed, shall remain in full forceand effect. SECTION 5. That all ordinances or_parts-of ordinances in conflict herewith are hereby expressly repealed. - SECTION 6. That the necessity for immediately -making the aforesaid - change for the purpose of maintaining at -all times a -comprehensive zoning - ordinance for the City of Corpus Christi creates -an imperative public neces- sity requiring the suspension of the Charter rule -that no ordinance nr_resolu-- -tion shall be passed finally on the date_of its introduction but -that such ordinance or resolution shall -be read at three several meetings_of the City— ` Council, and the Mayor or Council members,- having -declared that=such public necessity exists, having requested -the suspension of the Charter rule -and -- that this ordinance be passed finally on the date of its -introduction and- ' take effect and be in full force and effect from -and ater its_passage,—IT- IS ACCORDINGLY SO ORDAINED this the 27- dayof ATTEST: j/ erre Cite ecrtary APPROVED: 7.1 DAY OF J.
