URGING THE GOVERNOR'S CONSIDERATION OF OPENING THE 67TH
LEGISLATIVE SPECIAL SESSION CALL TO HB 104 BY REPRESENTATIVES
RILEY AND GONZALES GRANTING AUTHORITY TO COUNTIES TO BAN THE
POSSESSION AND SALE OF FIREWORKS.
WHEREAS, the cost to taxpayers for fire suppression and fire
prevention resulting from the selling, possessing and discharging of fireworks
within the State of Texas continues to increase annually; and
WHEREAS, the City Council, recognizing the need to prohibit the
selling, possessing and discharging of fireworks within the City's limits,
has previously passed ordinances making such activities illegal within the
City and within five thousand feet (5,000') of the City's limits; and
WHEREAS, the availability of fireworks beyond the five thousand
foot=(5,000') limit from the City and the selling of such fireworks in
areas not regulated by the City, has resulted in continued and substantial
personal property loss and injury; and
WHEREAS, as recently as July 4, 1981, areas of the City of Port
Aransas were threatened by brush fires resulting from the discharging of
fireworks in areas on Mustang Island outside of municipal jurisdiction; and
WHEREAS, the aforementioned fires severely damaged valuable dune
vegetation on Mustang Island necessary to protect existing duneilstructures;
and
WHEREAS, the City has long recognized the need to seek additional
remedies other than to just ban fireworks from within the City's limits; and
WHEREAS, Representatives Ken Riley and Arnold Gonzales of Nueces
County have introduced into the Special Session. 'Y/HB 104 which would
allow Counties to ban the possession and sale of fireworks on a local option
basis:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Council of the City of Corpus Christi
urges the Governor's consideration of opening the 67th Legislative Special
Session Call to HB 104 by Representatives Riley and Gonzales, requesting
authority on a local option basis to'Gounties to ban the possession and sale
of fireworks in areas of the county outside the limits of an incorporated
city or town.

SECTION 2. The City Secretary is hereby directed to forward
copies of this resolution to the Governor, the Lieutenant Governor, the
Speaker of the House and Legislators from Nueces County,;urging—thatTh
HB 104 be added to the Special Session Call.
SECTION 3. The necessity of requesting that HB 104 be placed on
the 67th Legislative Special Session,,Call as hereinabove set forth, creates
a public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared that such emergency and necessity exist, having requested the
suspension of the Charter rule and that this resolution be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this the
29th day of July, 1981.
