AN ORDINANCE
FINDING THAT THE BAYFEST '81 ON SEPTEMBER 25 THROUGH
SEPTEMBER 27, 1981, IS IN THE INTEREST OF THE PUBLIC
WELFARE; CLOSING THE 1200 THROUGH 1600 BLOCKS OF NO.
SHORELINE BOULEVARD TO VEHICULAR TRAFFIC FROM 8 A.M.
FRIDAY, SEPTEMBER 18, 1981, THROUGH 12 NOON WEDNES-
DAY, SEPTEMBER 30, 1981; GRANTING THE EXCLUSIVE USE
OF FOUR MUNICIPAL PARKING LOTS AND THE BARGE DOCK TO
THE BAYFEST '81 SPONSORS FROM 6 P.M. FRIDAY, SEPTEM-
BER 25, 1981 THROUGH 12 MIDNIGHT SUNDAY,SEPTEMBER 27,
1981; AND ALLOWING THE USE OF THE STREET, SIDEWALKS,
MEDIANS, SEAWALL, MARINA, BARGE DOCK, AND FOUR MUNI-
CIPAL LOTS, MORE FULLY DESCRIBED IN EXHIBIT "A"
ATTACHED HERETO, FOR SAID BAYFEST CO-SPONSORED BY
THE JUNIOR LEAGUE OF CORPUS CHRISTI, TEXAS, AND THE
CORPUS CHRISTI ARTS COUNCIL; PROVIDING FOR BARRICAD-
ING AND EMERGENCY VEHICLE ENTRANCE; PROVIDING FOR
LIABILITY INSURANCE, RESTORATION OF DAMAGED CITY
PROPERTY, APPROVAL OF THE ENGINEERING & PHYSICAL
DEVELOPMENT DIRECTOR AND THE INSPECTIONS & OPERA-
TIONS DIRECTOR FOR CERTAIN CHANGES, REQUIRED PERMITS
FOR BEER AND FOOD, COMPLIANCE WITH CITY CODES AND
PROHIBITING CERTAIN PAVEMENT MARKINGS AND REQUIRING
THE SPONSORS TO RESTORE THE AREA FOR USE FOR VEHIC-
ULAR TRAFFIC; REQUIRING THE SPONSORS OF BAYFEST '81
TO REMIT 2 PERCENT OF GROSS RECEIPTS DERIVED FROM
THE FESTIVAL TO THE CITY OF CORPUS CHRISTI; AUTHOR-
IZING THE CITY MANAGER TO EXECUTE THE ATTACHED AP-
PLICATION PERMIT; PROVIDING AN EFFECTIVE DATE FOR
PUBLICATION; AND PROVIDING FOR SEVERANCE.
WHEREAS, the Junior League of Corpus Christi, Texas, and the Corpus
Christi Arts Council have formulated plans for the Bayfest '81 to be held on
Friday, September 25 through Sunday, September 27, 1981; and
WHEREAS, the purpose of said Bayfest '81 is to feature festival -
type booths and entertaining programs sponsored by numerous Corpus Christi
Civic Clubs and other organizations; and
WHEREAS, the proceeds from the Bayfest will be used for community
and civil projects; and
WHEREAS, the Junior League of Corpus Christi, Texas, and the Corpus
Christi Arts Council have requested that from 8 a.m. Friday, September 18,
1981, through Wednesday, September 30, 1981, certain blocks of North Shoreline
Blvd. be closed to vehicular traffic; and
WHEREAS, numerous civic and community groups will participate in the
Bayfest and have endorsed it; and
WHEREAS, the City Council finds that the proposed Bayfest will be in
the interests of the public welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That vehicular traffic be barred from the 1200 through
1600 blocks of North Shoreline Blvd. (both directions of travel) from 8 a.m.
Friday, September 18, 1981, to 12 Noon Wednesday, September 30, 1981, so that
the Junior League of Corpus Christi, Texas, and the Corpus Christi Arts Council
can co-sponsor a Bayfest '81, and that said areas be barricaded to through
traffic. It is directed that said areas be barricaded so as to allow emergency
vehicles, such as fire, police and ambulance vehicles, to enter said areas in
case of an emergency. It is further provided that vehicles of the City or
Utility Companies furnishing public utilities, such as electricity, gas, water,
and telephone services to said areas, be permitted to enter said areas in case
of an emergency. In addition to the above stated street closure by this ordin-
ance, the sponsors of Bayfest '81 are granted the exclusive use of the sidewalks,
medians, seawall, marina, four municipal parking lots adjacent to I.H. 37
access roads and the municipal barge dock on North Shoreline from 6 p.m. Friday,
September 25, 1981 to midnight Sunday, September 27, 1981. Said areas are more
fully described in Exhibit "A" attached hereto.
SECTION 2. That in maintaining the street and public areas closed
by this ordinance, the following regulations shall be observed:
A. Liability insurance shall be furnished free of cost to the City,
protecting against liability to the public and Bayfest participants, including
volunteer workers. Such insurance shall have policy limits of at least
$500,000 for personal injury or death, $1,000,000 per occurrence, and $100,000
property damage, and shall name the City of Corpus Christi, Texas, the Junior
League of Corpus Christi, Texas, and the Corpus Christi Arts Council as insureds.
A Certificate of Insurance in the above amounts shall be furnished the City
Secretary and approved by the City Attorney with the application and permit
provided for hereinafter.
B. Any damage to City property will be restored by the sponsor of
the aforesaid Bayfest promptly after the close of the Bayfest.
C. Any activities involving the use of the seawall, marina, or
barge dock must be approved by the Inspections & Operations Director.

D. Any work which involves holes or other changes in the pavement,
curbs, sidewalks, seawall, or barge dock must be approved by the Engineering &
Physical Development Director and no such approval may be given if the work
will require repair by the City.
E. Appropriate permits must be obtained from the Alcoholic Beverage
Commission for the sale of beer and the City -County Health Department for the
sale of foods.
F. The construction work for displays within the areas affected by
this ordinance shall be conducted in accordance with City specifications and
in accordance with the electrical, plumbing, and building construction codes
of the City and after furnishing adequate assurance that all damages will be
remedied by the permittee.
G. No paint or markings shall be permitted which in any way oblit-
erates or defaces any pavement markings heretofore existing for the guidance
of any motor vehicle.
H. After the Bayfest ends, the sponsors will see that the street
is cleaned and restored to a condition to allow vehicular traffic to return
to the streets at the expiration of the closure of the street.
I. Within 60 days after the Bayfest ends, the sponsors shall remit
2 percent of the gross receipts derived from the festival to the City of
Corpus Christi.
SECTION 3. The City Manager is authorized to execute the attached
application/permit for and on behalf of the City, which shall be filed for
record in the Office of the City Secretary.
SECTION 4. The provisions of this ordinance relating to closing of
the aforementioned streets are effective for the period beginning at 8 a.m.
Friday, September 18, 1981, through noon Wednesday, September 30, 1981. The
other provisions of this ordinance are effective from and after the date of
publication of the caption of this ordinance in the official publication of the
City one time. However, no part of this ordinance shall be effective until the
Manager and authorized representatives of the sponsoring organizations execute
the aforementioned application/permit, and the Certificate of Insurance is
approved and filed.

SECTION 5. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption of this
ordinance, stating in substance the purpose of the ordinance.
SECTION 6. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word, or provision of this ordinance, for it is the definite intent of this
City Councilthatevery section, paragraph, subdivision, clause, phrase,
word, or provision hereof be given full force and effect for its purpose.

KNOW ALL MEN BY THESE PRESENTS:
Application
The Junior League of Corpus Christi, Texas, and the Corpus Christi
Arts Council, in order to sponsor the Bayfest '81 on September 25, 26, and 27,
1981, hereby make application, acting by and through Mrs. Sarah Norris and
Mrs. Mary Ann Rhodes, Bayfest '81 Co -Chairwomen representing the Junior
League of Corpus Christi, Texas, and the Corpus Christi Arts Council to the
City of Corpus Christi, acting by and through R. Marvin Townsend, its duly
authorized representative, for the closing to vehicular traffic of the 1200
through 1600 blocks of North Shoreline Blvd., from 8 a.m. Friday, September 18,
1981, through noon Wednesday, September 30, 1981; and granting the exclusive
use of the street, sidewalks, medians, seawall, marina, four municipal park-
ing lots, and the barge dock to the sponsors of Bayfest '81 from 6 p.m. Friday,
September 25, 1981 through midnight Sunday, September 27, 1981. In considera-
tion of the closing of said street and the use of said public areas, the
sponsoring organizations hereby agree:
1. To allow emergency vehicles to use such areas as may be required
in said areas.
2. To furnish liability insurance in the amounts of at least
$500,000/$1,000,000/$100,000, a Certificate of which is attached hereto.
3. To restore any damaged City property promptly after the date of
the Bayfest.
4. To obtain the approval of the Director of Engineering & Physical
Development for any work which requires holes or other changes in the pavement,
curb, or sidewalk.
5. To obtain the approval of the Director of Inspections & Operations
to use the Marina and Barge Dock.
6. To obtain the appropriate beer and food permits.
7. To construct all displays in accordance with the appropriate City
Codes, and furnish adequate portable restrooms.
8. To provide certain barricades and not less than one uniformed
security guard.
9. To not obliterate or deface any pavement markings heretofore -
existing for the guidance of motor vehicles.
10. To clean the area and restore it for use for vehicular traffic
after the close of the Bayfest. Sponsors agree to pay the City half the cost
of the City crew cleanup, i.e. hosing down, push-brooming sidewalks and streets,
and running. street sweeper, with the understanding that there will be no such
cleanup charge if the sponsors have removed_all loose debris from the permit
area.
11. To remit 2 percent of the gross receipts derived from the festi-
val to the City of Corpus Christi within 60 days after the Bayfest ends.
