HomeMy WebLinkAbout16439 ORD - 07/29/1981mb;7/31/81;2nd AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, AS AMENDED, BY AMENDING SECTION 55-5, CITY TRANSIT SYSTEM --FARES, BY AMENDING PARAGRAPH (A), SUBPARAGRAPHS (1), (2), (3), (4), (6), (7), (9) AND (10), SO AS TO ESTABLISH NEW FARE RATES FOR FIXED ROUTE SERVICE AND PERMIT THE SALE OF A MONTHLY PASS; TO REPEAL PARAGRAPH (A), SUBPARAGRAPH (8), AND PARAGRAPH (D), TO ELIMINATE ZONE DESCRIPTIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY. WHEREAS, Ordinances No. 9864, 11548, 12855, 14285, 14476, 14953 and 15456 passed and approved by the City Council, established a system of rates and zones for fixed-rate City bus service; and WHEREAS, the City Council has determined that a 50 -cent base fare for adult transit riders is necessary; and WHEREAS, the City Council finds that the hereinafter prescribed rates are reasonable, just and fair, being in the public interest; and WHEREAS, the City Council has determined that a simplified rate structure and the elimination of a zone system is essential: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, City of Corpus Christi, 1976 Revision, as amended, be amended by amending Section 55-5, City Transit System Fares, by amending Paragraph (A), Subparagraphs (1), (2), (3), (4), (6), (7), (9), and (10), so as to establish new fare rates for fixed route service and permit the sale of monthly bus passes. (A) City Transit System Fixed -Route Service (1) All riders using fixed route transit service shall pay the base fare of fifty -cents ($0.50) in coins, or one token or ticket issued by the Transit System. Tokens or tickets shall be sold at the rate of five (5) for two dollars and twenty-five cents ($2.25). (2) For children from their sixth to their twelfth birthdays, the rate shall be twenty-five cents ($0.25). (3) For students, regardless of age, in actual attendance at any academic or public or private school of grades not higher �6J than the public high school of the City of Corpus Christi, the 66J rate shall be twenty-five cents ($0.25) upon showing school identification approved by the Transit System. -SEP 2 71984- 16439 School passes shall be valid for twenty (20) rides and sold for five dollars ($5.00). (4) For children under the age of six (6) years, when accompanying a fare -paying passenger, there shall be no charge. (6) For passengers sixty-five (65) years or older and for handi- capped persons, upon presentation of a Medicare card or special identification card, the fare shall be twenty-five cents ($0.25). If a person sixty-five (65) years of age or older does not have a Medicare card, then a special identifi- cation will be issued to that person at no cost, upon appearing in person at the Transit Office and providing evidence of age. If a handicapped person does not have a special identification card, then one will be issued to that person at no cost, by the Transit Office upon certification' by a doctor or by a community agency which serves the handicapped to the effect that the person is handicapped. For the purpose of this subsection, a "handicapped person" shall be defined as any individual who, by reason of a permanent physical disability or incapacity, is unable to utilize mass transit services without special assistance. (7) All persons enrolled in the youth services program administered by the Corpus Christi Independent School District shall be entitled to purchase regular 20 -ride student passes at the student rate of five dollars ($5.00). (9) Passengers making trips on express bus service shall pay a premium fare of not less than seventy-five cents ($0.75) nor more than one -dollar ($1.00) depending upon the length of the trip, as in the following table: One -Way Mileage One -Way Trip Rate 0-20 $0.75 20 + $1.00 (10) The City Transit System is authorized to sell, with the approval of the City Manager, special punch type passes which would be valid for a predetermined number of rides or a monthly pass at a charge of twenty -dollars ($20.00) which would be valid for unlimited rides during the calendar month for which it is issued. Such a monthly pass would be valid on regularly scheduled services. SECTION 2. That Paragraph (A), Subparagraph (8) and Para- graph CD). of Section 55-5, City Transit System Fares are hereby repealed, SECTION 3. If for any reason, any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 6. The necessity to immediately establish new fare rates for fixed route service creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordi- nance or resolution shall be passed finally on the date of its introduction, but that such ordinance or resolution shall be read at three meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effe on August 1, 1981, IT IS ACCORDINGLY ORDAINED this the .29 day of AGGEST: , 1981.
