HomeMy WebLinkAbout16452 ORD - 08/12/1981AN ORDINANCE AMENDING SECTION 55-63 OF THE CODE OF ORDINANCES_ OF CORPUS PASSED ANDISTI, APPROVED6BYAS THEDCCITYDBY COUNCILIOONNCE SEPTE13415, PASSED 1976, SO AS TO INCREASE THE CHARGE FOR SERVICE REQUESTED BY CUSTOMERS FOR LIGHTING AND ADJUSTING OR TURNING OFF ONE OR MORE NATURAL GAS APPLIANCES, AND CONVERSION OF BURNER ORIFICES FOR NATURAL GAS AT RESIDENTIAL, APARTMENT, OR MOBILE HOME ADDRESSES EXCEPT FOR THOSE HEADS OF HOUSEHOLDS 65 YEARS OF AGE OR ABOVE OR THE RECIPIENTS OF SOCIAL SECURITY DISABILITY PAYMENTS EXEMPTED BY THE DEPARTMENT OF PUBLIC UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERANCE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 55-63 of the Code of Ordinances, City of Corpus Christi, 1976, as adopted by Ordinance No. 13415, passed and approved by the City Council on September 22, 1976, be and the same is hereby amended to hereinafter read as follows: "Section 55-63. Charges for lighting, etc. of natural gas appliances. There shall be a $10.00 charge per appliance service order request for lighting, adjusting, or turning off one or more natural gas appliances, or the conversion of burner orifices to burn natural gas, at a residential, apartment, or mobile home address. Such $10.00 charge includes all gas appliances for which service is requested. All other customers shall be charged $10.00 for each appliance lighted, adjusted, or turned off. Maintenance of appliances is not included in the lighting and adjusting of any gas appliance except for gaslight mantles and glasses, which will be billed to the customer requesting service at a retail price over and above the charge set forth above. Provided, however, that in the event the head of a household is 65 years of age or above, or the recipient of Social Security disability payments and resides at a residential, apart- ment, or mobile home address, then no charge shall be made by the City for such service. Proof of eligibility for the exemptions provided herein shall be on a form to be prescribed by the Director of Public Utilities." MICROFILW1' SEP 27 1984 16152 SECTION 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 3. If for any reason any section, paragraph, subdivi- sion, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivi- sion, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. This ordinance shall take effect and be in full force beginning on August 12, 1981. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance.
