AN ORDINANCE
AMENDING SECTION 17-12 OF THE CORPUS CHRISTI CODE RE-
QUIRING WRITTEN NOTICE OF DAMAGES SO AS TO DELETE THE
REQUIREMENT THAT THE WRITTEN NOTICE BE DULY VERIFIED
BY AFFIDAVIT.
WHEREAS, the Texas Supreme Court in the case of Artco-Bell Cor-
ooration v the City of Temple decided May 20, 1981, and reported in 24
Tex. Supreme Ct. Journal, pg.. 416, held that the requirement of verifi-
cation -0f notice of claim to be given the City was contrary to the author-
ity extended to -_cities by Article 1175 Section 6 of the revised Civil
Statutes and hence=is tnvali&.
BE TT -ORDAINED -BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION -l. That >.- Chapter- 17 of the Corpus Christi Code Section
17-12 be and -the same is hereby_ amended-by_deleting the words "duly verified
_Ir affidavit."
