AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH TUCKER PROPERTIES PROVIDING FOR PAYMENT BY THE
DEVELOPER TO THE CITY TO FUND SANITARY SEWER FACILI-
TIES AND THEIR EXTENSIONS INTO THE CLUB ESTATES UNITS
4, 5 AND 6 AREAS AND CROSSGATE SUBDIVISION (FORM-
ERLY CLUB ESTATES NO. 6) AND FOR FUTURE CLUB ESTATES
OR CROSSGATE SUBDIVISION UNITS, SAID PAYMENT TO BE
USED TO FUND FUTURE SANITARY SEWER EXTENSIONS ACCORD-
ING TO THE MASTER SANITARY SEWER PLAN, AND PROVIDING
FOR INTERIM LIFT STATION AND FORCE MAIN, ALL AS MORE
FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY
OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with Tucker Properties providing for payment by the
developer to the City to fund sanitary sewer facilities and their extensions
into the Club Estates Units 4, 5 and 6 and Crossgate Subdivision (formerly
Club Estates No. 6) and for future Club Estates or Crossgate Subdivision
units, said payment to be used to fund future sanitary sewer extensions
according to the Master Sanitary Sewer Plan, and providing for interim lift
station and force main, all as more fully set forth in the agreement, a sub-
stantial copy of which is attached hereto and made a part hereof, marked
Exhibit "A".
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
preserving public property by executing the above agreement and expediting
construction of necessary improvements, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration
and voting upon ordinances or resolutions at three regular meetings so that
this ordinance is passed and shall take effect upon first reading as an emer-
gency measure this .(. day of August, 1981.

AGREEMENT
THE STATE OF TEXAS X
COUNTY OF NUECES X
This agreement is authorized by Ordinance No. and is
entered into between the City of Corpus Christi, hereinafter called "City",
acting by and through its duly authorized City Manager, R. Marvin Townsend, and
Tucker Properties, a partnership, hereinafter called "Developer", and pertains
-to paying the City an established and agreed fee on the lot or acreage basis
_for the purpose of helping fund future sanitary sewer facilities and their
__-extensions into the Club Estates Units 4, 5 and 6 areas.
WHEREAS. Developer proposes to develop a residential subdivision known
as Club Estates 4, 5 and 6 comprising approximately 193.90 acres as shown on
attached EXHIBIT "A", and
WHEREAS, saidpreliminary plan of Club Estates 4, 5 and 6 per EXHIBIT
"A"'has been submitted to the Planning Commission, and
WHEREAS, Developer and City discussed the matter of sanitary sewer
service and lot participation at $150.00 per lot or $600.00 per acre for all of
Club Estates Units 4, 5.and 6 during the City Council meeting of November 26,
1980, and
WHEREAS, said acreage or lot participation by Developer will be used
by City to extend sanitary sewers in South Staples Street and other areas of the
City per the Master Plan for Sanitary Sewer for the City of Corpus Christi, and
WHEREAS, Developer and City both recognize the public necessity to
extend the 21" diameter sanitary sewers in South Staples Street immediately
south of Saratoga Boulevard, which would provide ultimate gravity sanitary sewer
to the Club Estates Units 4, 5 and 6 development, and
WHEREAS, Developer has changed the name of the Club Estates Unit 6 to
Crossgate Subdivision as shown on attached EXHIBIT "B",
NOW THEREFORE Developer and City agree as follows:
1. City will permit the construction of the Crossgate Subdivision
(formerly Club Estates Unit 6 unfiled) without the construction of the 21"
diameter sanitary sewer line in South Staples Street with the provision that
the Developer will be permitted to construct, at Developer's expense, an interim
lift station and force main to provide for temporary sewer service to the
subdivision. The lift station must be constructed on South Staples Street
frontage and would pump to the existing City lift station mear the intersection
of South Staples Street and Saratoga Boulevard.
2. Developer agrees to pay City the sum of $150.00 per lot for each
lot in Crossgate Subdivision. In accordance with EXHIBIT "B", Crossgate Sub—
division contains 311 lots for a total of $46,650.00 to be paid the City.
Developer is obligated to -make --this payment, on the $150.00 per lot basis
within 30 days after the individual lots are sold.
3. Developer further agrees to pay the City the sum of $150.00 per
lot for all lots developed on property other. than Club Estates Unit S (former
.name) or Crossgate Subdivision, asshown on EXHIBIT "A", on the same 30 day post
lot sale bafiis-when such additional property is platted and developed in accord—
ance with City requirements.
4. City will attempt to find the funds necessary to install the 21"
diameter sanitary sewer line in South Staples Street to provide ultimate gravity
sanitary.sewer service to Crossgate Subdivision and the future units shown on
EXHIBIT "A". In the event such funds are not available. Developer will proceed.
-with interim sanitary -sewer service as described herein.
"5. This agreement shall be executed in duplicate, both of which shall
be considered an. original. When executed, this agreement shall become effective
-and shall be binding upon the parties, their respective successors and assigns`
and shall constitute a covenant running with the land and such instrument shall
be filed of record forthwith.
