HomeMy WebLinkAbout16470 ORD - 08/12/1981. ; $/6/8l; Zai AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, UPON APPLICATION OF SITTERLE AND COMPANY BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A PORTION OF LOTS 8 AND 9, SECTION 5, RANGE VIII, GUGENHEIM AND COHN'S FARM LOTS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING AND "A-1" APART- MENT HOUSE DISTRICT TO "I-2' LIGHT INDUSTRIAL DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Sitterle and Company for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, August 12, 1981 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE I.T ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1.. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the hereinafter described tract of or parcel of land, described as a portion of Lots 8 and 9, Section 5, Range VIII, Gugenheim and Cohn Farm Lots, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby rezoned from "R -1B" One Family Dwelling District and "A-1" Apartment House District to "I-2" Light Indus- trial District: Beginning at a concrete monument in the southeast right-of-way line of Old Brownsville Road, a 120' wide road, from whence the intersection of the northwest right-of-way line of Old Brownsville Road with the northeast right-of-way line cr South Padre Island Drive bears N 530 48' 29" W, 126.19' and S 54° 12' 32" W, 718.16'; THENCE: S 53° 48' 29" E, 453.60' to a point in the west line of St. Martin's Subdivision as recorded at Volume 32, page 126, Mop Records, Nueces County, Texas; THENCE: With said west line S 0° 08' 12" E, 294.34' to a 5/8" iron rod for corner; THENCE: With the south line of St. Martin's Subdivision, N 89° 42' 48" E, 44.00' to a 5/8" iron rod for corner; THENCE: 5 0° 03' 12" E, 492.49' to a 5/8" iron rod for corner; THENCE: S 49° 04' 47" W, 64.63' to a 5/8" iron rod in the northeast line of Gabriel Terrace as recorded at Volume 30, page 15, Map Records, Nueces County, Texas; THENCE: With said northeast line N 40° 55' 12" W 865.33' to a 5/8" iron rod at the northeast corner of Gabriel Terrace; THENCE: N 89°_44! 37" E, 33.48' to a 1" iron pipe for corner; THENCE: N 0° 10' 43" W, 177.90' to a 1" iron pipe; THENCE: • N 0° 17' 12" W, 30.00' to a 5/8" iron rod for corner; THENCE: S 89° 42' 48" W, 155.95' to a 5/8" iron rod in the southeast right-of-way line of Old Brownsville Rood for corner; THENCE: With said southeast right-of-way line, N 54° 12' 32" E, 402.94' to the point of beginning, containing 9.12 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances -or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity forimmediately-making the aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates an imperative public neces- sity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City . Council, and the Mayor or Council members, having declared that such public necessity exists, having requested the suspension of the Charter rule and :that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the day of g_,, 1981.
